GENTEXT/REMARKS/1.  PURPOSE.  THIS MARADMIN ANNOUNCES CHANGE 7 TO MCO P5800.16A, THE MARINE CORPS MANUAL FOR LEGAL ADMINISTRATION, EFFECTIVE 10 FEBRUARY 2014.  THIS CHANGE COMPLETELY REVISES CHAPTERS 1-6 AND SHOULD BE REVIEWED IN ITS ENTIRETY.
2.  BACKGROUND.  IN FURTHERANCE OF REFERENCE A, THIS CHANGE UPDATES THE MISCONDUCT AND MILITARY JUSTICE CHAPTERS OF THE MANUAL AND IMPLEMENTS THE VICTIMS' LEGAL COUNSEL ORGANIZATION.  THIS CHANGE MODIFIES THE TRIAL SERVICES ORGANIZATION BASED ON THE 2012 REORGANIZATION OF THE MARINE CORPS LEGAL COMMUNITY AND CLARIFIES THE DUTIES AND RESPONSIBILITIES OF TRIAL SERVICES PERSONNEL.  ADDITIONALLY, THIS CHANGE UPDATES POLICIES SURROUNDING OFFICER MISCONDUCT CASES, ENLISTED NONUDICIAL PUNISHMENT, AND ABSENTEES AND DESERTERS.
3.  THIS CHANGE CONTAINS THE FOLLOWING MAJOR REVISIONS:
A.    CHAPTER 1, MILITARY JUSTICE.  FORMALIZES THE ROLES AND RESPONSIBILITIES OF LEGAL SERVICES PERSONNEL IMPLEMENTED IN THE 2012 LEGAL REORGANIZATION, IDENTIFIES SPECIAL VICTIM CASES, AND OUTLINES TRIAL SERVICES QUALIFICATIONS AND DETAILING AUTHORITIES.
B.    CHAPTER 2, THE MARINE CORPS DEFENSE SERVICES ORGANIZATION (DSO).  UPDATES MINOR MODIFICATIONS TO THE DSO SINCE THE 2012 LEGAL REORGANIZATION.
C.    CHAPTER 3, ENLISTED NONJUDICIAL PUNISHMENT MATTERS AND PREPARATION OF THE UNIT PUNISHMENT BOOK.  AMENDS THE PREVIOUS VERSION, CLARIFYING INSTRUCTIONS AND REQUIRED ACTIONS.
D.    CHAPTER 4, OFFICER MISCONDUCT AND SUBSTANDARD PERFORMANCE OF DUTY.  PROVIDES UPDATED GUIDANCE ON THE OFFICER MISCONDUCT AND SUBSTANDARD PERFORMANCE REPORTING AND DISPOSITION PROCESSES, ENSURES CONSISTENCY IN INITIAL REPORTS TO REDUCE DISPARATE TREATMENT OF SIMILAR ADVERSE MATERIAL, AND INCORPORATES A WEB-BASED OFFICER DISCIPLINARY NOTEBOOK MANAGEMENT SYSTEM FOR REPORTING PROCEDURES.
E.    CHAPTER 5, ABSENTEES, DESERTERS, IN HANDS OF CIVILIAN AUTHORITIES (IHCA), AND IN HANDS OF FOREIGN AUTHORITIES (IHFA).  AMENDS THE PREVIOUS VERSION, CLARIFYING INSTRUCTIONS AND REQUIRED ACTIONS.
F.    CHAPTER 6, THE MARINE CORPS VICTIMS' LEGAL COUNSEL ORGANIZATION (VLCO).  COMPLIES WITH THE SECRETARY OF DEFENSE'S DIRECTIVE AND THE FISCAL YEAR 2014 NATIONAL DEFENSE AUTHORIZATION ACT TO ESTABLISH A VICTIM'S ADVOCACY CAPABILITY; FORMALIZES THE SCOPE OF SERVICES OFFERED; DELINEATES THE ROLES AND RESPONSIBILITES OF THE MARINES ASSIGNED TO THE VLCO; AND ESTABLISHES THE POLICIES, PROCEDURES, AND SUPPORT REQUIRED.
4.  CHANGE 7 TO THE LEGADMINMAN IS PUBLISHED ELECTRONICALLY AND CAN BE ACCESSED ON-LINE VIA THE MARINE CORPS WEBSITE AT THE MARINE CORPS PUBLICATIONS ELECTRONIC LIBRARY.
5.  ACTION.  FILE THIS MARADMIN IMMEDIATELY FOLLOWING CHANGE 6 OF THE BASIC ORDER.
6.  THIS CHANGE IS APPLICABLE TO THE MARINE CORPS TOTAL FORCE.
