Individuals requesting information under the auspices of the Freedom of Information Act should contact MCAS Beaufort Freedom of Information Act Office by phone, email or fax their request to the number listed above.

 

The Freedom of Information Act (FOIA), 5 United States Code (USC) 552, allows an individual (regardless of nationality), a private organization or company, or a local, state, or foreign government to seek access to Executive Branch agency records, such as those held by the U.S. Marine Corps.  As a component of the Department of the Navy, Secretary of the Navy Instruction 5720.42F, Department of the Navy Freedom of Information Act (FOIA) Program, governs the Marine Corps FOIA program.

 

Processing FOIA requests

 

     1.   Minimum requirements of a FOIA Request.  A request must be in writing; cite or imply FOIA; reasonably describe the records being sought so that a knowledgeable official of the agency can conduct a search with reasonable effort; and If fees are applicable, the requester should include a statement regarding willingness to pay all fees or those up to a specified amount or request a waiver or reduction of fees.

 

     2.   If a request does not meet the minimum requirements of the FOIA, the Requestor Service Center will apprise the requester of the defect and assist him/her in perfecting the request.  Please note the statutory 20 working day time limit applies upon receipt of a “perfected” FOIA request.

 

     3.   When a requester or his/her attorney request personally identifiable information in a record, the request may require a notarized signature or a statement certify under the penalty of perjury that their identity is true and correct.  Additionally, written consent of the subject of the record is required for disclosure from a Privacy Act System of records even to the subject’s attorney.

     4. To request Naval Criminal Investigative Service record under the FOIA you must e-mail your request to NCISFOIA@navy.mil

              a. Describe the specific records(s) you are seeking with enough detail so that a knowledgeable agency official may locate the record(s) with a reasonable amount of effort. Such detail should include descriptive information, timeframe to be searched, full names, and any other pertinent information that may assist in identifying the subject of the request.

              b. State your willingness to pay all fees or those up to a specified amount or provide a justification to support a fee waiver.

              c. Be sure to include your name, address (including zip code) and telephone number.
