GENTEXT/REMARKS/1.  Purpose.  The purpose of this MARADMIN is to provide amplifying guidance on ADOS policy regarding 365-day waivers, 1095-day waivers, high active duty time (HADT) waivers, and waivers of active duty sanctuary and cumulative active duty service.
2.  Background.  ADOS is a tool commanders can use to meet temporary administrative, operational, and exercise support requirements.  ADOS orders should be short-term in nature with a clearly defined termination date.  Policy contained in references A, B, D, E, G, H, I, and J limit the duration of ADOS orders. Specifically:
  a.  Conventional ADOS orders will not be funded for greater than 365 days without written approval by Director, Reserve Affairs (RA).  In accordance with reference G, at some point, a break between orders of 31 days or greater is required to mitigate the excessive costs of separations pay due to the accrual of six cumulative years of active duty without a break of at least 31 days from orders in a six year period.
  b.  In accordance with reference D, reservists are limited to serving 1,095 days on active duty in a 1,460-day period (“1095 rule”) when assigned to ADOS-Contingency Operations (CO), ADOS AC or ADOS RC orders.  Individuals who exceed this limitation will count against end-strength authorized for active duty.
  c.  Additionally, per reference E, policy has been established to closely monitor reserve marines serving on voluntary ADOS orders as they accumulate “high active duty time.”  Reservists with HADT (defined as exceeding 16 years of total active duty time) have limited mobilization capability.
3.  Situation.  As a result of high operational tempo over the past several years, waivers have been granted out of necessity.  This practice has created situations where reservists are accruing high active duty time, becoming eligible for separations pay, counting against active duty end-strength, and crossing over 18 years of cumulative active duty service.  Ultimately, this impacts the effective management of manpower end-strength, manpower costs, the future mobilization capacity of reservists, and the individual reservist.
4.  Action.
  a.  All waiver requests for ADOS-ac and ADOS-RC orders will be submitted to the Director, Reserve Affairs.  Waiver requests applicable to ADOS-CO orders will be submitted to MMIB-2 for consideration.  Request for waivers must be signed by the commander, chief of staff, commanding officer, officer-in-charge, director, or an individual “acting” in one of these capacities.  Waiver requests signed with "by direction" authority will be returned without action.  For IMA units, all waiver requests must be signed by the operational chain of command.
  b.  1095-day waivers.  In order to manage active duty end-strength, Manpower and Reserve Affairs, will closely scrutinize 1095 waivers for each fiscal year.  Diligence on the part of Manpower and Reserve Affairs is required to ensure that limitations are not exceeded.
  c.  High Active Duty Time.  Reserve Marines required to submit HADT waivers in order to receive voluntary ADOS orders will be closely scrutinized.
  d.  Waivers of active duty sanctuary and cumulative active duty service.  Reserve Marines that are required to submit a HADT waiver for orders that will carry them to 16 years of active duty service or more will be required to submit a signed waiver of sanctuary (NAVMC 11668) with the HADT waiver request. If the request for orders is approved, the signed NAVMC 11668 will be forwarded to MMRP to be included in the Marines ESR.  Marines submitting a HADTW for orders that will carry them to or over 18 years of cumulative active duty service will not be permitted to execute orders that are greater than 179 days in duration, per reference J.
  e.  Submitting a NAVMC 11349 budget submission form for a requirement applies to funding availability only.  The Marine that will fill the requirement may require waivers for the orders to be approved in the Marine Resource Order Writing Service (MROWS).  Orders should be entered in MROWS 60 days before the orders start date.  Commanders are expected to carefully consider the cost of ADOS-funded orders.  Before orders are issued, every effort must be made to source temporary staffing needs with Marines residing within the local commuting distance.
5.  This MARADMIN is applicable to the Total Force.
6.  This MARADMIN cancels MARADMIN 003-13.
