GENTEXT/REMARKS/1. Purpose. To announce the changes to the Marine Corps Prohibited Activities and Conduct (PAC) Prevention and Response Policy.
2. Background. This Order updates, consolidates, and aligns existing policy prohibiting harassment (to include sexual harassment), unlawful discrimination, abuse (hazing, bullying, ostracism, retaliation, wrongful distribution or broadcasting of intimate images), and certain dissident and protest activity (to include supremacist activity). The Order addresses training and education, support for victims, and tightens accountability. Violation of the Order may result in punitive action. The subject Order revises and cancels multiple Marine Corps Orders and MarAdmins.
3. This change modifies the initial incident reporting processes and command actions for preventing and responding to prohibited activities and conduct complaints. Volume 1 contains clarification of the DoD requirement to report all allegations of harassment in accordance with reference (a) and directs all command actions and reporting timelines as amplified in Volume 3 of the Order. Volume 2 contains a deletion. Volume 3 contains changes to the initial reporting timelines, clarifies the use of duty and calendar days for required timelines, clarifies and changes the name of the online complaint reporting tool, adds informal resolution as a means of resolving interpersonal conflict at the lowest appropriate level, and standardizes reference to uniformed Service members throughout the Order. The Glossary contains four new definitions.
4. The following substantive changes to the initial assessment and reporting timeline for commanders contained in Volume 3 Paragraph 0402 INITIAL ASSESSMENT is hereby directed: 0402 INITIAL ASSESSMENT
All complaints of prohibited activities and conduct in violation of this Order shall be reported in accordance with the following requirements. Within three duty days of receipt of the complaint by the commander, commanders must make an initial assessment of a complaint of prohibited activities and conduct. Commanders shall consult with their EOA and SJA to determine the proper handling of a complaint. 040201. COMMANDERS INITIAL REPORTING ACTIONS. Within three duty days of receipt of the complaint by the commander, commanders will:
A. Forward the complaint, with a detailed description of the facts and circumstances, to the next superior officer in the chain of command who is authorized to convene a general court-martial;
B. Submit all reportable information to the EOA/MEO office and direct the supporting EOA to open an initial discrimination and sexual harassment (DASH) report. EOAs will execute the EOA/MEO actions in accordance with Chapter 5 of this Volume.
C. Submit an OPREP-3 SIR Report to the Marine Corps Operations Center (MCOC) in accordance with reference (k) for all accepted complaints. If the commander determines within three duty days of receipt of the complaint, by the commander, to accept in accordance with paragraph 040301 below, then an OPREP-3 SIR is required. The voice report to the MCOC is required upon the commander's determination to accept the complaint. In accordance with reference (k), the OPREP-3 SIR will include as much information as is available, but should at a minimum contain the date, time, location, unit, installation, personnel involved, and a general description of the alleged prohibited activity and conduct. 040202. WHEN AN OPREP-3 SIR IS NOT REQUIRED. No OPREP-3 SIR is required if, within three duty days of receiving a complaint, the commander dismisses the complaint in accordance with paragraph 0404, or refers the complaint in accordance with paragraph 040302.

6. This updated policy contains significant changes. Commanders and senior enlisted advisors are encouraged to read the policy in its entirety. Commanding Generals with assigned Equal Opportunity Advisors (EOAS) should have their EOA conduct a comprehensive review of their own program to ensure appropriate updates are made to local policies and procedures.
7. PAC Training. Effective upon release of this MARADMIN, commanders must ensure personnel are trained on the Prohibited Activities and Conduct (PAC) policy, MCO 5354.1E. Training conducted in calendar year 2018 under previous policies on Equal Opportunity, Sexual Harassment and Hazing do not meet the requirements of the new policy. PAC Training will be conducted by an Equal Opportunity Advisor or Equal Opportunity Representative using approved training material at https:(slash)(slash)www.manpower.usmc.mil/webcenter/portal/MPE. The PAC training code PC is available on Marine Corps Training Information Management System (MCTIMS).
