GENTEXT/REMARKS/1.  Purpose.  The purpose of this MARADMIN is to announce the Fiscal Year 2020 military justice and special victim litigation training schedule for Marine Corps trial counsel, defense counsel, victims’ legal counsel (VLC), and legal support personnel.
2.  Background.  Pursuant to reference (a), the Staff Judge Advocate to the Commandant of the Marine Corps (SJA to CMC) is responsible for ensuring the quality of military justice practice within the Marine Corps.  The SJA to CMC is committed to providing timely, coordinated, and comprehensive legal support in cases involving special victims.  Therefore, in accordance with reference (b), the SJA to CMC requires trial counsel, defense counsel, and VLC to receive training on the unique requirements of conducting litigation involving special victims.
3.  Action
3.a.  To ensure the proper training of Marine Corps judge advocates and legal support personnel, Judge Advocate Division, HQMC, sponsors and facilitates training that addresses the full range of legal matters raised during special victim investigations and litigation.  Digital and physical forensics, medical evidence, ethical obligations and psychological aspects of special victim cases are taught at these courses.  Holding these courses annually ensures counsel and support personnel that have firsthand experience are refreshed and provided the opportunity to relay lessons learned to those new to the legal field.
3.b.  Marine Corps policy requires trial counsel to complete special victim investigation and prosecution (SVIP) focused intermediate-level trial advocacy training prior to being detailed to special victim cases.  Attending TCAP Worldwide SVIP Training or Prosecuting Special Victim Cases at Naval Justice School meets this requirement.  Counsel seeking an SVIP certification must consult with their regional leadership and Military Justice Branch, Judge Advocate Division to determine  whether any unlisted courses are sufficient to meet this requirement.
3.c.  Reference (c) requires the SJA to CMC to certify VLC.  Reference (c) requires VLC to attend in-depth certification training.  Judge advocates assigned to the Victims’ Legal Counsel Organization (VLCO) must attend one of the initial certification courses listed below to meet these requirements.  All personnel assigned to VLCO must attend the annual VLCO symposium.
3.d.  References (d)-(e) require counsel assigned to the Defense Services Organization (DSO) to complete a standard training program.  The training events in this program include the Defense Counsel Orientation course, annual DSO-wide Training, Defending Sexual Assault Cases course, and non-government operated trial advocacy skills courses.

4.b.  In accordance with references (a)-(b), and in order to ensure unity of effort among local efforts to provide training to trial counsel, defense counsel, VLC, and legal support personnel the below dates are set aside for regional training.  Regional counsel must coordinate with the cognizant Legal Services Support Section, Officer in Charge and the judicial circuit to vary from these dates as required to reduce the impact of training on the local military justice docket.

4.c.  Eligibility
4.c.1.  All trial counsel, defense counsel, VLC, trial administrative officers, regional trial investigators, and legal services specialists working within trial services offices, the DSO, or the VLCO are eligible to apply to attend the above listed courses.
4.c.2.  Other personnel who desire to attend the listed courses should contact Military Justice Branch, Judge Advocate Division for additional guidance.
4.d.  Registration.  Individual attendees may not register for any of the listed courses directly if seeking Judge Advocate Division funding.  The appropriate Regional Trial Counsel, Regional Defense Counsel, or Regional VLC must coordinate all training requests through either TCAP, DCAP, or the Deputy Officer-in-Charge of VLCO, as applicable, for approval, unless utilizing local funds exclusively.
4.e.  Funding. Guidance regarding funding will be published in separate correspondence.
4.f.  Cancellations. Cancellations must be received no less than five working days prior to the convening date of any listed course.  Cancellations may be made via email to the appropriate POC.  Attendees are responsible for cancelling any flight, lodging, or rental car reservations they made prior to the cancellation.
