GENTEXT/REMARKS/1.  General.  This MARADMIN announces references (a) and (b), which revise QCAR procedures for all court-martial convening authorities and officers exercising nonjudicial punishment authority.
2.  Action.
2.a.  In accordance with reference (a), reference (b) is effective immediately and the new report format shall be used for Fiscal Year 2021 quarterly reports.  Additionally, in order to comply with Section 540I of reference (c), General Court-Martial Convening Authorities (GCMCAs) must use the new report format to submit a supplemental Fiscal Year 2020 Fourth Quarter report that includes the required information for every summary court-martial proceeding completed on or after 17 June 2020 and before 1 October 2020.  GCMCAs will submit these supplemental reports by 1 December 2020.  A supplemental report for the Fiscal Year 2020 Fourth Quarter is not required for nonjudicial punishment proceedings.  Beginning 1 October 2020, Fiscal Year 2021 reports will collect data for both summary courts-martial and nonjudicial punishment proceedings.
2.b.  Reference (b), which includes a report template (a fillable Excel spreadsheet) and instructions on filling out the report template, may be accessed at the Judge Advocate General’s website at https:(slash)(slash)www.jag.navy.mil/library/instructions.htm (search for 5800.9E).
2.c.  Each court-martial Convening Authority and nonjudicial punishment authority must report the results of every summary court-martial and nonjudicial punishment conducted in the previous quarter to the first GCMCA in the administrative chain of command.  Reports shall be submitted using the report template included in reference (b).
2.d.  All GCMCAs must submit a report every quarter using the report template included in reference (b).  Each GCMCA will consolidate reports submitted from every subordinate court-martial convening authority and nonjudicial punishment authority into one spreadsheet and will add to the same spreadsheet all summary courts-martial or nonjudicial punishment proceedings conducted by the GCMCA.  Negative responses are required.  Marine Corps GCMCAs must submit their consolidated spreadsheet to the Commandant of the Marine Corps, Headquarters, U.S. Marine Corps (JMJ) at JAD_QCAR@usmc.mil.
2.e.  Report summary courts-martial and nonjudicial punishment proceedings for the quarter in which the proceeding was completed.  Reports shall be submitted within 30 days of the end of the quarter.
3.  Background.  Article 146a of reference (c) and Section 540I of reference (d) require the recording of detailed information related to military justice actions, including demographic information.  General court-martial and special court-martial data is collected by Marine Corps Legal Services Support Sections (LSSS) via the online Case Management System (CMS) or successor system.  Summary court-martial data is not consistently collected in CMS, and nonjudicial punishment proceeding data is not collected in CMS, as these proceedings may be conducted without the involvement of the cognizant LSSS.  As a result, all Marine Corps officers performing military justice functions must report on a quarterly basis the results of all summary courts-martial or nonjudicial punishment completed by their commands.
