GENTEXT/REMARKS/1.  Purpose.  This message announces the Fiscal Year (FY) 2023 Funded Law Education Program (FLEP) and Excess Leave Program (ELP) board convening on 8 November 2022.  This message is to announce the programs, eligibility criteria, and timelines for the FY23 FLEP and ELP execution.

2.  Background.
2a.  The Law Education Programs (LEP) are valuable opportunities for officers to complete graduate-level professional education and laterally transfer to the Marine Corps judge advocate primary MOS of 4402.
3.  Eligibility.
3.a.  General eligibility criteria.
3.a.1.  Applicants must be a citizen of the United States.
3.a.2.  Unrestricted commissioned officers in the Marine Corps on active duty.
3.a.3.  Officers applying for ELP must have a minimum of two-years time-on-station by matriculation.
3.b.  FLEP.
3.b.1.  Must be in the grade of captain or below.
3.b.2.  Have a minimum of two years but not more than six years total active duty time (commissioned and enlisted service combined) when law education begins.
3.b.3.  Be able to complete 20 years active service as a  commissioned officer before their 62nd birthday.  These are statutory qualifications and cannot be waived.
3.c.  ELP.
3.c.1.  An applicant must have a minimum of two years of commissioned service, with no more than eight years of total active duty time when law education begins.  Time-in-service (TIS) waivers will not be accepted.
3.d.  Ineligible criteria. 
3.d.1.  Officers previously selected to other Marine Corps Graduate Education Programs (MGEP) who are currently serving a utilization tour.
3.d.2.  Officers who have been selected to a MGEP or resident Professional Military Education (PME) School for FY23.
4.  School criteria.
4.a.  Applicants must thoroughly research and apply to a broad range of schools that offer in-state or out-of-state tuition.  Failure to do so may result in non-selection to the program.
4.b.  Letters of acceptance and application must state annual tuition for both in-state and out-of-state, and whether the applicant qualifies for in-state tuition.  Include all information that will affect associated costs, to include, but not limited to, scholarships, grants, cash awards.
4.c.  Although applicants are highly encouraged to apply for scholarships, fellowships, and grants, applicants must coordinate with and obtain prior approval from the MGEP manager.
4.d.  Commandant of the Marine Corps (JAD), in coordination with Manpower Management Officer Assignments (MMOA-3) and Training Education Command (TECOM) will select law schools for the FLEP selectees.
5.  Application process.
5.a.  The CAC enabled sample application can be found at https:(slash)(slash)www.manpower.usmc.mil/webcenter/portal/OA3LE/pages_home.
5.b.  Packages must be endorsed by the chain of command through the first general officer.
5.c.  Applicants must submit their official LSAT scores.  A minimum score of 150 is required.  Individuals seeking a waiver of the GRE in place of the LSAT refer to POC in paragraph 7. 
5.d.  Packages should include the names of law schools accredited by the American Bar Association to which the applicant has applied to and/or been accepted, in priority order.
5.e.  Applicants will ensure transcripts from all colleges and universities attended, with credits and letter grades, are contained in their application prior to the convening of the board.
5.f.  A statement of acceptance of the service obligation must be included in the application.  Below are the service obligation per program.
5.f.1.  Upon successful completion of FLEP, Marines incur two years (24 months) obligated active service for each year (12 months), or any part thereof, spent in the program.
5.f.2.  Upon successful completion of ELP, Marines incur one year (12 months) obligated active service for each year (12 months), or any part thereof, spent in the program.  In no case will the total period of obligated service under ELP be less than two years (24 months).
5.g.  Applicants must submit a privacy act statement.
5.h.  Email the application in Adobe PDF format to smbmmoagradedu@usmc.mil, naming the file “EDIPI_FLEP_LastName” or “EDIPI_ELP_LastName” or “EDIPI_FLEP_ELP_LastName” if applying for both.
5.i.  Officers who are eligible and desire to apply to both FLEP and ELP should submit a combined application.
6.  General information for eligible population.
6.a.  Applicants must notify their primary MOS monitor of intent to apply for FLEP and/or ELP prior to submitting application.
6.b.  Final selection to the program will be contingent upon MMOA-3 receiving the law school acceptance letters due no later than 15 April 2023.
6.c.  Upon release of the results MARADMIN, and after program requirements are achieved, PCS orders will be issued for all selected officers.
6.d.  Officers not yet career designated must be selected for and accept career designation prior to matriculation.
6.e.  Officers to be screened by the FY23 Officer Retention Board (ORB) may submit packages and must agree in writing to accept career designation when offered.
6.f.  If screened but not selected for career designation, selection to the FLEP and ELP programs will be disapproved.
