GENTEXT/REMARKS/1. PURPOSE. THE OFFICER VOLUNTARY EARLY RELEASE (OVER) PROGRAM IS A COST SAVINGS INITIATIVE THAT SHAPES AND SUSTAINS THE FORCE WITHIN BUDGETARY CONSTRAINTS. THIS MESSAGE SERVES TO ESTABLISH THE AUTHORITY, ELIGIBILITY, AND PROCEDURE FOR THE VOLUNTARY EARLY RELEASE OF ACTIVE DUTY OFFICERS WHOSE TERM OF SERVICE WILL EXPIRE IN FY12-FY14.
2. BACKGROUND. REF A PROVIDES THE AUTHORITY FROM THE SECRETARY OF THE NAVY TO ESTABLISH THE OVER PROGRAM. THE OVER PROGRAM WILL COMMENCE ON THE RELEASE DATE OF THIS MESSAGE AND WILL EXPIRE ON 30 SEPTEMBER 2014. MARINES APPROVED FOR THIS PROGRAM MAY SEPARATE NO MORE THAN 180 DAYS PRIOR TO THEIR CURRENT EXPIRATION OF ACTIVE SERVICE (EAS) AND WILL BE CONSIDERED TO HAVE COMPLETED THEIR FULL ACTIVE SERVICE. THIS MARADMIN DOES NOT EXEMPT MARINES FROM COMPLETING RESERVE OR READY RESERVE OBLIGATIONS PER THEIR INDIVIDUAL SERVICE CONTRACTS.
3. ELIGIBILITY.
   A. MARINES MUST HAVE FEWER THAN SIX YEARS OF COMMISSIONED SERVICE.
   B. ANY ACTIVE COMPONENT MARINE OFFICER WITH AN FY12, FY13, OR FY14 EAS (1 SEP 2012- 30 SEP 2014).
   C. MARINES MAY REQUEST TO SEPARATE NO MORE THAN 180 DAYS PRIOR TO THEIR CURRENT EAS. THIS IS NOT WAIVERABLE.
   D. MARINES MUST NOT BE STABILIZED FOR DEPLOYMENT AT THE TIME OF REQUESTED EARLY RELEASE (NEW EAS).
   E. ALL PRE-SEPARATION COUNSELING, PER TITLE 10 USC 1142, AND ALL MEDICAL SEPARATION QUALIFICATIONS MUST BE COMPLETE PRIOR TO THE DATE OF SEPARATION.
   F. MARINES MUST BE ELIGIBLE FOR AN HONORABLE OR GENERAL (UNDER HONORABLE CONDITIONS) DISCHARGE CHARACTERIZATION AT TIME OF EARLY RELEASE.
   G. INDIVIDUAL REQUESTS MUST BE SUBMITTED VIA ADCON BATTALION OR SQUADRON COMMANDING OFFICER WITH ENDORSEMENT TO BE CONSIDERED ELIGIBLE.
4. INELIGIBILITY. MARINES MEETING ANY OF THE FOLLOWING CONDITIONS ARE INELIGIBLE TO PARTICIPATE IN THE OVER PROGRAM:
   A. MARINES WHO HAVE ACCEPTED CAREER DESIGNATION.
   B. MARINES WHO ARE INDEBTED TO THE GOVERNMENT (TO INCLUDE ADVANCE AND EXCESS LEAVE). INDEBTED MARINES DESIRING EARLY SEPARATION WILL BE PERMITTED TO MAKE ACCELERATED REPAYMENT OF THEIR DEBTS BY INCREASING SCHEDULED INSTALLMENT AMOUNTS AND BY MAKING CASH COLLECTIONS TO REPAY THEIR INDEBTEDNESS. INDEBTEDNESS MUST BE ENTIRELY RESOLVED PRIOR TO EARLY RELEASE.
   C. MARINES BEING RELEASED UNDER OTHER HQMC DIRECTED EARLY OUT PROGRAMS, E.G., EARLY RELEASE TO ACCEPT PUBLIC OFFICE.
   D. MARINES THAT ARE CURRENTLY ON TERMINAL LEAVE AWAY FROM THE PERMANENT DUTY STATION PENDING SEPARATION.
   E. MARINES WHO MANIFEST SYMPTOMS OF POST TRAUMATIC STRESS DISORDER OR TRAUMATIC BRAIN INJURY AND ARE UNDERGOING POST DEPLOYMENT HEALTH EVALUATION AND MANAGEMENT CARE WILL NOT BE SEPARATED UNDER THIS AUTHORITY UNTIL THAT PROCESS IS COMPLETE OR A WAIVER OF TREATMENT EVALUATION HAS BEEN EXECUTED.
   F. MARINES PENDING COURT MARTIAL OR OTHER ADVERSE ADMINISTRATIVE ACTION SHALL NOT BE ELIGIBLE FOR THIS PROGRAM UNTIL ADJUDICATION IS COMPLETE.
5. PROGRAM TIMELINE. APPLICATION PROCESSING WILL COMMENCE IMMEDIATELY UPON RELEASE OF THIS MARADMIN. THE 180 DAY EARLY RELEASE WINDOW IS DETERMINED BASED ON THE MARINES ORIGINAL EAS. FOR EXAMPLE: A FIRST LIEUTENANT WHO IS NOT CAREER DESIGNATED AND HAS A CURRENT EAS OF 1 AUGUST 2013, MAY BE APPROVED FOR EARLY RELEASE NO EARLIER THAN 3 FEBRUARY 2013, WHICH IS 180 DAYS PRIOR TO HIS OR HER EAS. ADDITIONALLY, THE MARINE MUST MEET ALL ELIGIBILITY CRITERIA OUTLINED IN PARAGRAPH 3 OF THIS MARADMIN PRIOR TO EARLY RELEASE. UPON EARLY RELEASE, THE MARINE WILL BE CONSIDERED TO HAVE COMPLETED HIS OR HER FULL ACTIVE SERVICE. TO ALLOW FOR PROCESSING TIME, HQMC REQUIRES THAT OVER PACKAGES BE SUBMITTED AT LEAST 30 DAYS PRIOR TO REQUESTED EARLY RELEASE DATE. COMMANDERS ARE ENCOURAGED TO EXPEDITE REQUESTS AS EARLY IN THE FISCAL YEAR AS POSSIBLE IN ORDER TO MAXIMIZE BUDGETARY SAVINGS.
6. RESERVE COMPONENT OPPORTUNITY. THE SELECTED MARINE CORPS RESERVE IS ACTIVELY SEEKING THE SERVICE OF COMPANY GRADE OFFICERS IN ANY MILITARY OCCUPATIONAL SPECIALTY (MOS) WHO WANT TO REMAIN AFFILIATED WITH THE MARINE CORPS UPON TRANSITION FROM THE ACTIVE COMPONENT. OPPORTUNITIES EXIST FOR PLATOON OR COMPANY COMMAND, RESIDENT PROFESSIONAL MILITARY EDUCATION, CONGRESSIONAL FELLOWSHIPS, AND ADVANCED OR ADDITIONAL MOS TRAINING.  DEPENDING ON MOS, OFFICER AFFILIATION BONUSES MAY BE AVAILABLE FOR TRANSITIONING OFFICERS. THROUGH SERVICE IN THE DRILLING RESERVE, OPPORTUNITIES ALSO EXIST FOR CONTINUED FULL TIME ACTIVE DUTY SERVICE THROUGH THE ACTIVE RESERVE PROGRAM, ACTIVE DUTY FOR OPERATIONAL SUPPORT, AND VOLUNTARY MOBILIZATION. INTERESTED OFFICERS ARE ENCOURAGED TO CONTACT RESERVE CONTINUATION AND TRANSITION BRANCH; MAJOR ANDREW DAUSMAN AT DSN 278-0510 OR COMM: 703-784-0510.
7. COORDINATING INSTRUCTIONS.
   A. HQMC (MP) MAINTAINS ALL POLICY ASSOCIATED WITH THIS PROGRAM.
   B. HQMC (MM) MAINTAINS FINAL APPROVAL AUTHORITY FOR ALL REQUESTS.
   C. INDIVIDUAL MARINES MUST SUBMIT REQUESTS TO PARTICIPATE IN THE OVER PROGRAM VIA THEIR CHAIN OF COMMAND. ANY OFFICER THAT IS TAD OR FAP OR TEMPORARILY ASSIGNED TO ANOTHER UNIT MUST RECEIVE FINAL APPROVAL FROM THEIR PARENT COMMAND.
   D. ADCON BATTALION OR SQUADRON COMMANDERS WILL SUBMIT ALL REQUESTS FOR EARLY RELEASE TO HQMC (MMOA-3) VIA AA FORM.
      (1) COMMANDERS WILL RECOMMEND APPROVAL OF A SPECIFIC DATE FOR SEPARATION WHEN ENDORSING A MARINES REQUEST FOR EARLY RELEASE.  COMMANDERS ARE ADVISED THAT VACANCIES OCCURRING FROM MARINES APPROVED FOR THE OVER PROGRAM WILL BE FILLED BASED ON EACH MARINE'S ORIGINAL EAS AND NOT THE MARINE'S EARLY SEPARATION DATE. TERMINAL LEAVE AND POST-DEPLOYMENT MOBILIZATION RESPITE ADMINISTRATIVE ABSENCE MAY BE TAKEN IN CONJUNCTION WITH THIS PROGRAM BASED ON COMMANDERS' DISCRETION.
      (2) COMMANDERS WILL PROVIDE SPECIFIC JUSTIFICATION FOR INDIVIDUAL MARINES NOT RECOMMENDED FOR APPROVAL TO PARTICIPATE IN THE PROGRAM.
   E. UPON HQMC (MM) FINAL APPROVAL, MMOA-3 WILL REPORT THE NEW EAS OR ECC VIA MCTFS UNIT DIARY ENTRY PER REF B AND NOTIFY COMMANDERS VIA NAVAL MESSAGE OF EARLY OUT APPROVAL WITH INFO COPIES TO MSC OR MEF COMMANDERS AS WELL AS SERVICING REGIONAL IPACS.
   F. MARINES BEING SEPARATED WITH THE OVER PROGRAM WILL SIGN A PAGE 11 ENTRY IN THEIR OFFICER QUALIFICATION RECORD BOOK ACKNOWLEDGING THEY ARE A VOLUNTEER FOR THE OVER PROGRAM. EXAMPLE PAGE 11 ENTRY: QUOTE, I HAVE BEEN APPROVED FOR PARTICIPATION IN THE OFFICER VOLUNTARY EARLY RELEASE PROGRAM. I UNDERSTAND THAT MY NEW EAS IS (YYYYMMDD). I HAVE BEEN COUNSELED ON THE CONTENTS OF THE OFFICER VOLUNTARY EARLY RELEASE PROGRAM MARADMIN AND UNDERSTAND THAT I WILL BE CONSIDERED TO HAVE COMPLETED MY FULL ACTIVE SERVICE.  ADDITIONALLY, I UNDERSTAND THAT I AM NOT EXEMPT FROM COMPLETING ANY REMAINING RESERVE OR READY RESERVE OBLIGATIONS PER MY INDIVIDUAL SERVICE CONTRACT, UNQUOTE.
   G. UNIT DIARY ENTRIES REPORTING RELEASE FROM ACTIVE DUTY OR DISCHARGE WILL BE SUBMITTED PER REF B.
      (1) THE SEPARATION PROGRAM DESIGNATOR (SPD) CODE FOR ACTIVE DUTY OFFICERS BEING RELEASED FROM ACTIVE DUTY IS MCC1. THIS SEPARATION CODE APPLIES TO MARINES THAT HAVE REMAINING OBLIGATED SERVICE OR WISH TO TRANSFER TO THE RESERVE COMPONENT.
      (2) THE SPD CODE FOR ACTIVE DUTY OFFICERS BEING DISCHARGED FROM ACTIVE DUTY IS KCC1. THIS SEPARATION CODE APPLIES TO MARINES THAT HAVE COMPLETED EIGHT YEARS ACTIVE DUTY OBLIGATED SERVICE AND DO NOT WISH TO TRANSFER TO THE RESERVE COMPONENT. IT IS IMPERATIVE THAT COMMANDS NOTIFY THEIR DISBURSING OFFICERS (DO) REGARDING EACH MARINE'S EARLY SEPARATION PER REF C. THOSE ORGANIZATIONS RESPONSIBLE FOR SEPARATING MARINES ARE REQUIRED TO IMMEDIATELY NOTIFY THE DO VIA A NAVMC 11116 OF THE PENDING SEPARATION. A NAVMC 11060 MUST THEN BE SUBMITTED TO THE DO 1 WORKING DAY AFTER THE DROP ENTRY POST.
8. GENERAL INFORMATION.
   A. ALL CURRENTLY APPROVED OVER PACKAGES ARE STILL VALID. ALL PACKAGES CURRENTLY IN PROCESSING WILL CONTINUE TO BE PROCESSED AS SUBMITTED. MARINES WITH EXISTING APPROVED OVER PACKAGES CAN RESUBMIT A NEW PACKAGE TO TAKE ADVANTAGE OF THE INCREASED WINDOW IF DESIRED.
   B. IN THE EVENT OF FUTURE RECALL, MARINES RELEASED UNDER THIS MARADMIN WILL BE CONSIDERED AS BEING IN THE SAME STATUS AS THOSE WHO HAVE COMPLETED THEIR OBLIGATED PERIOD OF ACTIVE DUTY.
   C. MARINES WHO ARE ENTITLED TO SEPARATION PAY UPON NORMAL EAS, WHO ELECT, AND ARE APPROVED FOR EARLY RELEASE FROM ACTIVE DUTY UNDER THIS MARADMIN, WILL RETAIN THEIR ENTITLEMENT TO SEPARATION PAY PROVIDED THEY HAVE COMPLETED 6 YEARS OF ACTIVE SERVICE PRIOR TO THE DAY OF EARLY RELEASE (NEW EAS) FROM ACTIVE DUTY. MARINES ARE REMINDED THAT EARLY RELEASE FROM ACTIVE DUTY UNDER THIS MARADMIN COULD AFFECT THE AMOUNT OF THEIR SEPARATION PAY. IF EARLY RELEASE WOULD DISQUALIFY MARINES FOR SEPARATION PAY DUE TO LENGTH OF SERVICE CRITERIA UNDER THE LAW, MARINES WILL NOT BE RELEASED FROM ACTIVE DUTY UNTIL THEIR SERVICE LENGTH CRITERIA HAS BEEN MET.
   D. FOR THE PURPOSE OF POST-SERVICE BENEFITS, EARLY SEPARATION UNDER THIS PROGRAM IS CONSIDERED TO BE FOR THE CONVENIENCE OF THE GOVERNMENT (SERVICE MEMBERS ARE ENTITLED TO ALL APPLICABLE BENEFITS). AS A REMINDER, ELIGIBLE MARINES AND THEIR FAMILY MEMBERS DESIRING TO RETAIN TRICARE PRIME UPON SEPARATION ARE REQUIRED TO REENROLL IN TRICARE.
   E. MARINES ARE REMINDED TO REVIEW EDUCATIONAL BENEFITS PRIOR TO PARTICIPATING IN THE OVER PROGRAM. A LIST OF ELIGIBILITY REQUIREMENTS FOR THE POST 9-11 GI BILL CAN BE FOUND IN REF D AND E. MGIB REQUIREMENTS ARE FOUND IN REF F.
9. RESERVE APPLICABILITY. THIS MARADMIN IS NOT APPLICABLE TO THE MARINE CORPS RESERVE.
10. THIS MARADMIN CANCELS ON 30 SEP 2014.
