GENTEXT/REMARKS/1.  PURPOSE.  THE PACE OF DEVELOPMENT FOR RENEWABLE AND ALTERNATIVE ENERGY HAS SEEN A SIGNIFICANT INCREASE OVER THE PAST DECADE.  THIS TREND IS LIKELY TO CONTINUE AND PRESENTS A UNIQUE SET OF CHALLENGES TO MARINE CORPS AND DEPARTMENT OF DEFENSE OPERATIONS. REFERENCE (A) CONTAINS REQUIREMENTS FOR THE DEPARTMENT OF DEFENSE (DOD) TO COMPLETE A STUDY OF EFFECTS THE NEW CONSTRUCTION OF RENEWABLE ENERGY PROJECTS WOULD HAVE ON MILITARY INSTALLATIONS AND OPERATIONS.  THIS STATUTE ALSO ADDRESSES DOD HAZARD ASSESSMENTS; REQUIRING THE SECRETARY OF DEFENSE TO REVIEW PROJECTS, PROVIDE A PRELIMINARY ASSESSMENT OF THE LEVEL OF IMPACT ON MILITARY OPERATIONS, THE EXTENT OF MITIGATION THAT MAY BE NEEDED TO ADDRESS SUCH IMPACT, AND TO OBJECT IN THE EVENT A PROJECT WOULD RESULT IN AN UNACCEPTABLE RISK TO THE NATIONAL SECURITY OF THE UNITED STATES.  IN ORDER TO AFFECT THIS OUTCOME, THE OFFICE OF THE SECRETARY OF DEFENSE (OSD) HAS CONVENED A SITING CLEARINGHOUSE TO REVIEW AND PRESENT A UNIFIED DOD POSITION ON ANY RENEWABLE ENERGY PROJECT THAT HAS THE POTENTIAL TO IMPACT DOMESTIC MILITARY OPERATIONS.
2.  BACKGROUND.  ALL APPROPRIATE ACTIONS SHALL BE TAKEN TO ENSURE THAT MARINE CORPS ENTITIES DO NOT OBJECT TO A RENEWABLE ENERGY PROJECT PROPOSAL EXCEPT IN THE CASE IN WHICH, AFTER GIVING FULL CONSIDERATION TO MITIGATION ACTIONS, THE IMPACT PRESENTED BY THAT PROJECT COULD RESULT IN AN UNACCEPTABLE RISK TO THE NATIONAL SECURITY OF THE UNITED STATES.  TO MEET THIS OBJECTIVE, THERE MUST BE IN PLACE A LONG-TERM STRATEGY TO CONSISTENTLY AND QUICKLY RESPOND TO DEVELOPERS, BUREAU OF LAND MANAGEMENT AND OTHER FEDERAL, STATE AND LOCAL AGENCIES WITH CRITICAL MISSION IMPACT ANALYSES.  THE ABILITY TO ARTICULATE AND ADVOCATE FOR MARINE CORPS INTERESTS AT BOTH THE NATIONAL AND REGIONAL LEVELS IS ESSENTIAL, AND WILL BE ACCOMPLISHED THROUGH A FOCUSED ANALYSIS PROCESS CONSISTING OF A PRELIMINARY REVIEW OF PROJECT FEASIBILITY AND FOLLOW-ON COMPATIBILITY ASSESSMENT (IF REQUIRED).  BOTH PRODUCTS WILL CLEARLY OUTLINE MISSION IMPACTS AND PROVIDE THE BASIS FOR NEGOTIATIONS WITH PROJECT PROPONENTS AT ALL LEVELS.
    A.  REVIEW OF RENEWABLE ENERGY PROJECT PROPOSALS WILL BE INITIATED AT THE REGIONAL MARINE CORPS INSTALLATION COMMAND (MCI) LEVEL.  REGIONAL RENEWABLE ENERGY WORKING GROUPS SHALL BE ESTABLISHED AND MAINTAINED IN ORDER TO SERVE AS A SINGLE POINT OF CONTACT FOR THE COORDINATION OF PROJECT REVIEW EFFORTS.  DEPENDING ON SIZE, LOCATION, AND SCOPE, PROJECTS MAY REQUIRE REVIEW/ENDORSEMENT BY SEVERAL ECHELONS OF COMMAND AND EVENTUAL FORWARDING TO THE OSD SITING CLEARINGHOUSE WHICH WILL INVARIABLY RESULT IN A LENGTHY PROCESSING PERIOD.  INTENSIVE ENGAGEMENT VIA AN AGGRESSIVE COMMUNITY OUTREACH PROGRAM AT THE MCI LEVEL WITH LOCAL OFFICIALS, STATE AND FEDERAL GOVERNMENT AGENCIES, AND POTENTIAL DEVELOPERS SHALL BE INITIATED AND MAINTAINED IN ORDER TO PROVIDE A SUFFICIENT LEAD-TIME FOR A COMPLETE AND THOROUGH EVALUATION.
    B.  ENGAGEMENT WITH PROJECT PROPONENTS IS ESSENTIAL THROUGHOUT THE REVIEW PROCESS.  MARINE CORPS REGIONAL REPRESENTATIVES SHOULD ENSURE OPEN LINES OF COMMUNICATION WITH DEVELOPERS AND WORK TOWARDS ENACTING MITIGATIONS AT THEIR LEVEL.  AUTHORITY TO DETERMINE "UNACCEPTABLE RISK TO NATIONAL SECURITY," AND ULTIMATELY OBJECT TO A PROPOSED PROJECT LIES WITH THE OSD ONLY.  THE ABILITY TO ENGAGE WITH PROJECT PROPONENTS AT THE MCI LEVEL AND SEEK OUT MUTUALLY BENEFICIAL MITIGATIONS IN THE EVENT THAT A PROJECT DOES PRESENT A POTENTIAL IMPACT TO OPERATIONS, HOWEVER, IS NOT LIMITED BY THIS LANGUAGE. ONLY IN CASES WHERE THERE EXIST NO POSSIBLE MITIGATIONS TO THE IMPACT ON OPERATIONS A PROPOSED PROJECT WILL CAUSE AND WHERE THAT IMPACT WOULD RESULT IN A POTENTIAL FOR MISSION FAILURE WILL AN ENDORSED OBJECTION BE PRESENTED TO THE DOD SITING CLEARINGHOUSE FOR CONSIDERATION.
    C.  ALL PROPOSED PROJECTS PLANNED WITHIN 30 NAUTICAL MILES (NM) OF A MARINE CORPS INSTALLATION, LIVE FIRE RANGE, OR SPECIAL USE AIRSPACE (SUA); AND WITHIN 6 NM EITHER SIDE OF THE CENTERLINE OF A MARINE CORPS-OWNED MILITARY TRAINING ROUTE (MTR) WILL, AT A MINIMUM, UNDERGO A PRELIMINARY REVIEW AND, IF NECESSARY, A COMPATIBILITY ASSESSMENT.
       (1) A PRELIMINARY REVIEW SHALL BE THE PROCESS USED TO DETERMINE THE LEVEL OF RISK OF ADVERSE IMPACT ON MILITARY OPERATIONS AND READINESS THAT WOULD ARISE FROM THE CONSTRUCTION OF A PROPOSED PROJECT.  THE PRELIMINARY REVEIW DOES NOT DETERMINE A PROPOSED PROJECT'S COMPATIBILITY WITH MARINE CORPS OPERATIONS, BUT IS INTENDED TO PROVIDE AN INITIAL SNAP SHOT AND A PRELIMINARY UNDERSTANDING OF THE PROJECT'S LEVEL OF IMPACT ON MARINE CORPS OPERATIONS, TESTING, AND READINESS (OT-R).  THE PRELIMINARY REVIEW PROCESS WILL REQUIRE ALL INVOLVED TO CONSIDER FACTORS THAT DO OR DO NOT IMPACT MARINE CORPS OT-R AND DETERMINE WHAT LEVEL OF ANALYSIS SHOULD BE COORDINATED IN ORDER TO MAKE A FINAL COMPATIBILITY ANALYSIS.  ULTIMATELY, THIS REVIEW SHALL DETERMINE THE PROJECT AS EITHER:
            (A) NO RISK:  THE PROPOSED PROJECT PRESENTS NO SIGNIFICANT IMPACT TO MARINE CORPS OT-R.  NO FURTHER ASSESSMENT IS REQUIRED.
            (B) POTENTIAL RISK:  THE PROPOSED PROJECT MAY IMPACT MARINE CORPS OT-R.  FURTHER ASSESSMENT IS REQUIRED.
       (2) FOR ALL PROJECTS POSING A POTENTIAL RISK, THE MCI RENEWABLE ENERGY WORKING GROUP WILL INITIATE A COMPATIBILITY ASSESSMENT BASED ON THE RECOMMENDATIONS IN THE PRELIMINARY REVIEW.  THE COMPATABILITY ASSESSMENT IS A MORE DETAILED ANALYSIS AND SHOULD SPECIFY TECHNICAL AND READINESS IMPACTS TO MARINE CORPS OT-R.  THESE IMPACTS WILL BE ARTICULATED, QUANTIFIED, AND BACKED BY EMPIRICAL DATA THAT WILL BE DEFENDABLE WHEN PRESENTED TO HIGHER MARINE CORPS ECHELONS; OSD; INTERAGENCY WORKING GROUPS; STATE, TRIBAL, AND LOCAL GOVERNMENTS; DEVELOPERS; AND THE PUBLIC.  APPROPRIATE MODIFICATIONS TO STUDY PRESENTATIONS AND REPORTS FOR PUBLIC USE WILL BE MADE IF THE RESULTS OF A COMPATBILITY ASSESSMENT ARE CLASSIFIED.  THIS ASSESSMENT WILL CONTAIN THE FOLLOWING ELEMENTS:
            (A) TECHNICAL/SCIENTIFIC IMPACT STUDY.  THE PURPOSE OF THIS STUDY IS TO EXPLAIN THE IMPACT OR POTENTIAL IMPACT FROM A PROPOSED RENEWABLE ENERGY PROJECT ON EXISTING OR PLANNED TRAINING, TESTING, AND READINESS CAPABILITIES.  THIS STUDY MUST PROVIDE RELEVANT AND CREDIBLE TECHNICAL AND SCIENTIFIC FOUNDATION THAT THE MARINE CORPS CAN DEPEND ON WHEN DEFENDING MISSION REQUIREMENTS AGAINST PROPOSED INCOMPATIBLE ACTIVITIES.
            (B) READINESS AND MISSION IMPACT STUDY.  THIS STUDY WILL DOCUMENT, VALIDATE, AND JUSTIFY THE IMPACT FROM INCOMPATIBLE RENEWABLE ENERGY DEVELOPMENT ON THE MARINE CORPS' ABILITY TO EXECUTE MISSION REQUIREMENTS AND COMBAT OPERATIONS.  TO PREPARE THIS STUDY, MULTIPLE COMMANDS MUST WEIGH IN WITH THE DETAILS AND QUANTIFIED ANALYSIS OF THE MISSION REQUIREMENTS AND HOW THEY ARE MET. INFORMATION DOCUMENTED IN THE TECHNICAL AND SCIENTIFIC IMPACT STUDY SHOULD ASSIST IN MAKING THE ARGUMENT AS TO HOW THESE USES ARE IMPACTED BY IMPEDING ENCROACHMENT.  IT WILL BE IMPORTANT TO EFFECTIVELY CORRELATE CHANGES OR IMPACTS TO THE INTENSITY OR FREQUENCY OF TRAINING AND TESTING TO THE INCREASED RISK OF NOT MEETING OPERATIONAL OBJECTIVES OR REQUIREMENTS, LOSING EQUIPMENT ADDITIONAL COSTS, INCURRING PERSONNEL INJURIES OR LOSING LIVES.  THE IMPACT SHOULD BE SPECIFIC AND QUANTIFIED TO THE EXTENT POSSIBLE. HOWEVER, IT IS RECOGNIZED THAT QUALITATIVE ASSESSMENT AND BEST PROFESSIONAL JUDGMENT MAY BE NECESSARY.  THE OPINION AND ANALYSIS OF SUBJECT MATTER EXPERTS AND QUALIFIED MILITARY WARFARE SPECIALISTS WILL BE NECESSARY TO ASSESS MARINE CORPS ABILITY TO EXECUTE MISSIONS AND CONDUCT COMBAT OPERATIONS.  COMMANDS MUST USE FORESIGHT, INITIATIVE, AND DISCRETION IN ANALYZING LOSSES.  FOR EXAMPLE, LOST OPPORTUNITIES FOR INNOVATION AND LOST OPERATIONAL FLEXIBILITY ARE LEGITIMATE IMPACTS NOT NORMALLY DOCUMENTED AS REQUIREMENTS.
            (C) ANALYSIS OF MITIGATION OPTIONS.  THE FEASIBILITY OF MITIGATION OPTIONS THAT ADDRESS CONFLICTING PRIORITIES BETWEEN A PROPOSED RENEWABLE ENERGY PROJECT AND MARINE CORPS OT-R MUST BE DOCUMENTED.  INSTALLATIONS, MCI COMMANDS, AND HQMC HAVE A KEY ROLE IN DEVELOPMENT AND EVALUATION OF MITIGATION OPTIONS.  MITIGATION OPTIONS MUST INCLUDE ACTIONS THAT CAN BE TAKEN BY THE MARINE CORPS AS WELL AS THE PROJECT PROPONENTS.  FOR EXAMPLE, PURCHASE OF RESTRICTIVE EASEMENTS TO PROTECT AIRSPACE, THE WILLINGNESS OF DEVELOPERS TO MOVE PROPOSALS TO ACCEPTABLE ALTERNATIVE AREAS, AND POTENTIAL FOR LOCAL OR STATE GOVERNMENT INTERVENTION.  THE IMPACT ANALYSIS AND POTENTIAL MITIGATION OPTIONS CAN ALSO BE USED TO ENGAGE LOCAL OFFICIALS AND PROPONENTS TO NEGOTIATE COMPATIBLE ALTERNATIVES THAT REDUCE IMPACTS TO ACCEPTABLE LEVELS WHILE MEETING THE INTERESTS OF PROJECT STAKEHOLDERS.
            (D) STATEMENT OF COMPATIBILITY.  STATED AS:  COMPATIBLE, COMPATIBLE WITH SITE SPECIFIC STIPULATION/MITIGATIONS, OR NOT COMPATIBLE.
    D.  FEDERAL AVIATION ADMINISTRATION (FAA) NOTICE OF PROPOSED CONSTRUCTION AND OBSTACLE EVALUATION/AIRPORT AIRSPACE ANALYSIS.
        (1) AN OBSTACLE EVALUATION/AIRPORT AIRSPACE ANALYSIS IS REQUIRED IF A PROPOSED PROJECT MEETS OR EXCEEDS ANY OF THE CONDITIONS OUTLINED IN REFERENCE (B).  ALTHOUGH POTENTIAL IMPACTS POSED BY RENEWABLE ENERGY PROJECTS ARE NOT LIMITED SOLELY TO FLIGHT SAFETY AND AIR NAVIGATION, REFERENCE (A) HAS CLOSELY LINKED THE DOD ESC REVIEW PROCESS TO THIS FAA PROCESS.
        (2) THE REGIONAL AIRSPACE COORDINATORS SERVE AS THE FOCAL POINT FOR MANAGEMENT OF AIRSPACE ENCROACHMENT ISSUES WITHIN THEIR RESPECTIVE REGIONS.  AS SUCH, REGIONAL AIRSPACE COORDINATORS, IN CONCERT WITH NAVY AND MARINE CORPS FAA LIAISONS, SHALL SERVE AS THE PRIMARY VEHICLE FOR THE RECEIPT AND REVIEW OF AN OBSTACLE EVALUATION. IF INITIAL NOTIFICATION OF A PROPOSED PROJECT COMES IN THE FORM OF A FORMAL OBSTACLE EVALUATION REQUEST, REGIONAL AIRSPACE COORDINATORS WILL BE RESPONSIBLE FOR ENSURING INTIATION OF THE REVIEW PROCESS VIA THE RENEWABLE ENERGY WORKING GROUP.
        (3) UNDER CURRENT STATUTES, PROJECT DEVELOPERS ARE NOT LEGALLY REQUIRED TO SEEK DOD APPROVAL FOR ANY PROJECT THAT DOES NOT MEET THE THRESHOLD FOR FAA EVALUATION.  AS SUCH, REGIONAL COMMANDS MUST MAINTAIN A ROBUST COMMUNITY OUTREACH PROGRAM TO ENSURE REGULAR ENGAGEMENT WITH POTENTIAL DEVELOPERS IN ORDER TO IDENTIFY ANY IMPACTS POSED BY A RENEWABLE ENERGY PROJECT.
    E.  RESPONSIBILITIES
        (1) HEADQUARTERS MARINE CORPS (HQMC) LAND USE AND MILITARY CONSTRUCTION BRANCH (LFL), SHALL SERVE AS THE MARINE CORPS FOCAL POINT FOR SHARING INFORMATION ABOUT MAJOR COMPATIBILITY AND SUSTAINABILITY ISSUES AND IS RESPONSIBLE FOR DEVELOPMENT AND COORDINATION OF THE MARINE CORPS POSITION ON COMPATIBILITY, REQUIREMENTS, AND SUSTAINABILITY ISSUES FOR USE IN INTERACTION WITH REGULATORY AGENCIES, ELECTED OFFICIALS, FEDERAL, STATE, LOCAL AGENCIES, AND OTHER OUTSIDE ENTITIES.  THIS INCLUDES COMMUNICATION OF THE MARINE CORPS POSITION TO AND FROM THE DEPUTY ASSISTANT SECRETARY OF THE NAVY (DASN), ENERGY, INSTALLATIONS, AND ENVIRONMENT (EI-E) FOR INCLUSION IN THE JOINT STAFF EXECUTIVE STEERING GROUPS AND DOD SITING CLEARINGHOUSE.
        (2) COMMANDING GENERAL, MARINE CORPS COMBAT DEVELOPMENT COMMAND (CG MCCDC) SHALL SERVE AS THE FINAL AUTHORITY FOR ALL ISSUES IMPACTING MAGTF TRAINING PRESENTED BY PROPOSED RE PROJECTS.
        (3) HQMC, AVIATION COMMAND AND CONTROL SYSTEMS (APX) BRANCH, SHALL SERVE AS THE FINAL AUTHORITY FOR ALL AVIATION ISSUES PRESENTED BY PROPOSED RENEWABLE ENERGY PROJECTS.
        (4) MARINE CORPS LIAISONS TO THE FAA SHALL SERVE AS THE CONDUIT FOR THE FAA OBSTACLE EVALUATION PROCESS AND SHALL PROVIDE CG MCCDC (C465), MCI COMMANDERS, AND REGIONAL AIRSPACE COORDINATORS WITH NOTIFICATION OF PROPOSED CONSTRUCTION OR ALTERATION (FAA FORM 7460-1) RECEIVED FROM THE FAA.  ALL REQUESTS FOR INFORMATION REGARDING A MARINE CORPS POSITION PERTAINING TO ENCROACHMENT OF OPERATIONAL IMPACT SHALL BE COORDINATED THROUGH HQMC, LFL-2.
        (5) COMMANDERS, MARINE CORPS INSTALLATION COMMANDS AND COMMANDERS AT THE MARINE CORPS BASE/STATION LEVEL SHALL COMPLETE A PRELIMINARY REVIEW REGARDING THE LEVEL OF RISK OF ADVERSE IMPACT ON MILITARY OPERATIONS POSED BY THE PROJECT.  ADDITIONALLY, SHOULD A RISK OF IMPACT BE IDENTIFIED, A FOLLOW-ON COMPATIBILITY ASSESSMENT SHALL BE COMPLETED.
3.  ACTION
    A.  HQMC, LFL.
        (1) REVIEW, AMPLIFY (AS NEEDED), AND ENDORSE ALL PRELIMINARY REVIEWS AND COMPATABILITY ASSESSMENTS ROUTED UP THROUGH THE CHAIN OF COMMAND.  ROUTE ENDORSED PRELIMINARY REVIEWS AND COMPATABILITY ASSESSMENTS TO THE DASN, EI-E FOR SUBMISSION TO THE DOD EXECUTIVE STEERING COMMITTEE (ESC).
        (2)  MAINTAIN LIAISON WITH THE OSD ESC VIA THE DASN, EI-E TO ADVOCATE FOR MARINE CORPS POSITION ON ENERGY PROJECT PROPOSALS.
    B.  HQMC, APX.  UPON RECEIPT OF ENDORSED OBJECTION, AMPLIFY AS NEEDED, AND ROUTE TO HQMC, LFL FOR FINAL ENDORSEMENT.  APX WILL COORDINATE WITH THE MILITARY LIAISONS TO FAA HEADQUARTERS, THE FAA REGIONS, AND THE MARINE CORPS INSTALLATION REGIONAL AIRSPACE COORDINATORS TO ENSURE THAT PROJECTS WHICH NEGATIVELY IMPACT MARINE CORPS OPERATIONS ARE ANNOTATED IN THE FAA'S OBSTACLE EVALUATION DATABASE.
    C.  CG MCCDC (C465).  UPON RECEIPT OF ENDORSED OBJECTION, AMPLIFY AS NEEDED, AND ROUTE TO HQMC, LFL FOR FINAL ENDORSEMENT.
    D.  COMMANDERS, MARINE FORCES COMMANDS.
        (1) NOTIFY HQMC, LFL, HQMC, APX, AND CG MCCDC (C465) OF ANY PROPOSED RENEWABLE ENERGY PROJECTS WITHIN RESPECTIVE REGIONS THAT MAY IMPACT MARINE CORPS OPERATIONS.
        (2) AS NEEDED, REVIEW AND ENDORSE ALL PRELIMINARY REVIEWS/COMPATABILITY ASSESSMENTS RECEIVED FROM RESPECTIVE REGIONAL COMMAND AND ROUTE TO HQMC, LFL VIA HQMC, APX AND CG MCCDC (C465).
    E.  COMMANDING GENERALS, MARINE CORPS INSTALLATION COMMANDS (CG,MCI)
        (1) CONVENE A REGIONAL RENEWABLE ENERGY WORKING GROUP (REWG) TO SERVE AS THE FOCAL POINT FOR IDENTIFICATION AND REVIEW OF PROPOSED RENEWABLE ENERGY PROJECTS. THE REWG SHOULD INCLUDE REPRESENTATIVES FROM THE REGIONAL COMMUNITY PLANS AND LIAISON OFFICE (CPLO), REGIONAL RANGE AND TRAINING AREA MANAGMENT, REGIONAL AIRSPACE COORDINATOR, GOVERNMENT AND EXTERNAL AFFAIRS OFFICE, AND ENCROACHMENT CONTROL TEAM.
        (2) ENSURE A PRELIMINARY REVIEW IS COMPLETED.
        (3) AS NEEDED, PROVIDE ASSISTANCE THROUGHOUT THE PRELIMINARY REVIEW AND COMPATABILITY ASSESSMENT PROCESS.
        (4) UPON RECEIPT OF PRELIMINARY REVIEW AND/OR COMPATABILITY ASSESSMENT, REVIEW AS NEEDED, ENDORSE, AND FORWARD TO HQMC, LFL VIA RESPECTIVE MARFOR (IF OPERATING FORCE INPUT IS REQUIRED), CG MCCDC, AND HQMC APX-25.
    F.  COMMANDERS, MARINE CORPS BASES AND STATIONS
        (1) WITHIN (7) DAYS OF NOTIFICATION OF PROPOSED PROJECT, AND IN CONCERT WITH THE RENEWABLE ENERGY WORKING GROUP, CONDUCT A PRELIMINARY REVIEW TO DETERMINE LEVEL OF RISK A PROPOSED PROJECT PRESENTS.
