GENTEXT/REMARKS/1. THIS MARADMIN APPLIES TO ALL ORGANIZATIONS AND POSITIONS CURRENTLY COVERED BY THE NATIONAL SECURITY PERSONNEL SYSTEM (NSPS).
2. THE RECENTLY ENACTED NATIONAL DEFENSE AUTHORIZATION ACT FOR FISCAL YEAR 2010 (NDAA 2010) CONTAINS A PROVISION TO REPEAL NSPS AND REQUIRES THE TRANSITION OF NSPS EMPLOYEES, WITH NO LOSS IN PAY, TO PREVIOUSLY EXISTING CIVILIAN PERSONNEL SYSTEMS. THE DEPARTMENT OF THE NAVY'S TIMELINE FOR TRANSITIONING EMPLOYEES OUT OF NSPS IS PENDING APPROVAL BY THE DEPUTY SECRETARY OF DEFENSE. THE TIMELINE PROPOSES TO TRANSITION MARINE CORPS EMPLOYEES CONVERTING BACK TO THE GENERAL SCHEDULE (GS) SYSTEM IN MAY AND JUNE 2010 AND EMPLOYEES CONVERTING BACK TO THE ACQUISITION DEMONSTRATION PROJECT (ACQDEMO) IN JANUARY 2011.
3. IN ORDER TO BE PREPARED TO MEET THIS TIMELINE IF APPROVED, THE COMMANDS ARE REQUIRED TO REVIEW EACH POSITION IN THE ORGANIZATION TO DETERMINE THE GRADE OF THE POSITION UPON TRANSITION BACK TO THE PREVIOUS PERSONNEL SYSTEM. THE MARINE CORPS' STANCE IS THAT ALL POSITIONS AND ORGANIZATIONS BE STRUCTURED TO ACHIEVE EFFICIENCY AND ECONOMY IN SUPPORT OF THE MISSION OF THE ORGANIZATION. IT IS IMPERATIVE THAT AS WE EXIT NSPS, POSITION DESCRIPTIONS BE ACCURATE.
4. ALL COMMAND TABLES OF ORGANIZATION AND EQUIPMENT (T/OE) WERE REVIEWED DURING THE USMC BASE-LINING EFFORT AND UPDATES RECORDED IN THE TOTAL FORCE STRUCTURE MANAGEMENT SYSTEM (TFSMS) IN JANUARY 2009 PER REFERENCE (A). APPROVED T/OES WERE REQUIRED TO REFLECT EQUIVALENT GS GRADES FOR EACH CIVILIAN BILLET/POSITION LISTED. THE TRANSITION OUT OF NSPS REQUIRES A FULL REVIEW OF POSITIONS FOR ACCURACY AND IMPACT ON THE COMMAND'S MISSION. HOWEVER, IT IS NOT A TIME FOR RESTRUCTURING OR REORGANIZATION. COMMANDS MUST ADHERE TO THE GS POSITION STRUCTURE LISTED ON THE T/OE AS APPROVED AND REFLECED IN THE FY 09 BASE-LINING. COMMANDS ARE REQUIRED TO MINIMIZE THE NUMBERS AND LAYERS OF SUPERVISORS AND HIGH GRADE (NSPS PAY BAND 3 OR GS -14/15) POSITIONS.
5. COMMANDS SHOULD USE LEGACY GS POSITIONS DESCRIPTIONS (PDS) IF THEY ARE ACCURATE. IF USED, SUPERVISORS MUST CERTIFY LEGACY PDS BY SIGNING AND DATING THE FOLLOWING STATEMENT ON THE OF8 PD COVERSHEET:
"I CERTIFY THAT THIS IS AN ACCURATE STATEMENT OF THE MAJOR DUTIES AND RESPONSIBILITIES OF THIS POSITION AND ITS ORGANIZATIONAL RELATIONSHIPS, AND THAT THE POSITION IS NECESSARY TO CARRY OUT GOVERNMENT FUNCTIONS FOR WHICH I AM RESPONSIBLE. THIS CERTIFICATION IS MADE WITH THE KNOWLEDGE THAT THIS INFORMATION IS TO BE USED FOR STATUTORY PURPOSES RELATING TO APPOINTMENT AND PAYMENT OF PUBLIC FUNDS, AND THAT FALSE OR MISLEADING STATEMENTS MAY CONSTITUTE VIOLATIONS OF SUCH STATUTES OR THEIR IMPLEMENTATION."
6. COMMANDS MUST USE THE T/OE AS A STANDARD WHEN DETERMINING THE GRADE OF POSITIONS UPON TRANSITION. ANY DECISION TO RECLASSIFY A POSITION THAT RESULTS IN A CHANGE IN THE GS GRADE RECORDED ON THE T/O AND E MUST BE PROCESSED VIA THE TABLE OF ORGANIZATION AND EQUIPMENT CHANGE REQUEST (TOECR) IDENTIFIED IN CHAPTER 5 OF REFERENCE (A) AND REFERENCE (B). CHANGES RESULTING IN A REQUESTED INCREASE TO THE GS GRADE RECORDED ON THE T/OE MUST BE ACCOMPANIED BY:
A. FULLY CLASSIFIED PDS. THESE PDS WILL BE REVIEWED IN THE TOTAL FORCE STRUCTURE PROCESS.
B. COMMAND ORGANIZATION CHART REFLECTING POSITION.
C. JUSTIFICATION FOR THE CHANGE IN GRADE.
D. VERIFICATION FROM THE SERVICING HUMAN RESOURCES OFFICE (HRO), IF THE POSITION IS OCCUPIED, AS TO WHETHER THE CHANGE IN GRADE WILL BE AN ACCRETION OF DUTIES FOR THE INDIVIDUAL OCCUPYING THE POSITION, OR THE POSITION WILL HAVE TO BE COMPETED BASED ON ELIGIBILITY OF OTHER SIMILARLY SITUATED EMPLOYEES WHO MAY BE ELIGIBLE FOR THE PROMOTION. ACCRETIONS WILL NOT BE BASED ON THE INCUMBENT'S SALARY, BUT MUST BE BASED ON THE POSITION REQUIREMENTS.
E. IDENTIFICATION OF FUNDING SOURCE (IF AN INCREASE IN GRADE) UTILIZING THE CIVILIAN MANPOWER TOECR WORKSHEET PER REFERENCE (B). IF ELECTING TO SOURCE A POSITION INCREASE THROUGH THE ELECTION OF AN EXISTING POSITION, THE ASSOCIATED BILLET IDENTIFICATION MUST BE PRESENTED. INCREASES IN LABOR COST DOES NOT EQUATE TO AN INCREASE IN TOTAL OBLIGATIONAL AUTHORITY. COMMAND'S MUST VALIDATE THAT SOURCES BEING PROVIDED TO SUPPORT LABOR COSTS INCREASES DO NOT CREATE UNEXECUTABLE PROGRAMS (I. E., MUST HAVE A BALANCE BETWEEN MANPOWER, MATERIAL, MACHINE AND METHODS) AND BE CAPABLE OF DELIVERING EXPECTED PRODUCTS/SERVICES.
7. TOECRS WILL BE PROCESSED AS EXPEDITIOUSLY AS POSSIBLE. IN THE EVENT TOECRS ARE PENDING AT THE TIME OF SCHEDULED TRANSITION, EMPLOYEES WILL BE CONVERTED TO THE GS GRADE IDENTIFIED ON THE T/OE UNTIL A DECISION IS RENDERED.
8. COMMANDS THAT HAVE NOT DELEGATED CLASSIFICTION AUTHORITY UNDER REFERENCE (C) TO THE HUMAN RESOURCES SERVICE CENTER (HRSC), ARE URGED TO OBTAIN ADVISORY CLASSIFICATION OPINIONS FORM THE SERVICING HUMAN RESOURCES OFFICE. ALTHOUGH THE DOD CLASSIFICATION GUIDANCE AUTHORIZES THE USE OF "PEN AND INK" CHANGES TO CURRENT NSPS PDS, USMC REQUIRES POSITIONS THAT NEED CLASSIFICATION DETERMINATION TO BE WRITTEN IN THE GS FACTOR EVALUATION SYSTEM (FES) FORMAT FOR TRANSITIONING AN EMPLOYEE BACK TO GS. REQUIRING PDS TO BE WRITTEN IN THE FES FORMAT WILL HELP SUPERVISORS AND MANAGERS EXPLAIN RESULTING GRADES WHEN DEBRIEFING POSITION DETERMINATIONS TO EMPLOYEES PRIOR TO CONVERSION. ADDITIONALLY, THE FES FORMAT WILL BE DEFENDABLE IN ANY APPEAL OR THIRD PARTY REVIEW (MSPB, ETC). DUE TO THE INCREASED WORKLOAD NECESSARY TO ACCOMPLISH THE VOLUME OF CLASSIFICATION ACTIONS THAT MAY BE REQUIRED, THE DIRECTOR, CIVILIAN PERSONNEL PROGRAMS WILL ESTABLISH A CORE OF CONTRACT SUPPORT CLASSIFICATION SPECIALISTS TO ASSIST COMMANDS.
9. COMMANDS SHOULD BEGIN THE POSITION REVIEW AND NECESSARY CLASSIFICATION ACTIONS NOW. ONCE THE POSITION REVIEW AND REQUIRED CLASSIFICATION ACTIONS ARE COMPLETE, EMPLOYEES SHOULD BE ADVISED OF THE OUTCOME.
10. FOR THOSE COMMANDS ELIGIBLE TO TRANSITION POSITIONS TO THE CIVILIAN WORKFORCE ACQDEMO, CLASSIFICATION ACTIONS ARE NOT REQUIRED AT THIS TIME. FURTHER DETAILS ON THE REQUIREMENTS FOR TRANSITIONING ACQDEMO POSITIONS WILL BE RELEASED AS THEY BECOME AVAILABLE.
