GENTEXT/REMARKS/1. PURPOSE. THIS MARADMIN PROMULGATES POLICY FOR
THE ACTIVATION, ASSIGNMENT, AND RETENTION OF RESERVISTS WHO HAVE
SIXTEEN OR MORE YEARS OF ACTIVE SERVICE.
2. BACKGROUND.
A. SANCTUARY. REF A DIRECTS THAT OFFICERS AND ENLISTED MEMBERS OF
THE RESERVE COMPONENT ON ACTIVE DUTY WITHIN TWO YEARS OF RETIREMENT
ELIGIBILITY (THE EIGHTEEN YEAR ACTIVE SERVICE MARK) NOT BE
INVOLUNTARILY RELEASED BEFORE BECOMING ELIGIBLE FOR RETIREMENT PAY
UNLESS APPROVED BY THE SERVICE SECRETARY. THIS IS KNOWN AS
SANCTUARY.
B. REF B LIMITS RESERVISTS FROM PERFORMING ADSW BEYOND SIXTEEN
YEARS OF ACTIVE SERVICE. THIS LIMIT ALLOWS MANAGEMENT OF THE IMPACT
ON PROMOTIONS, END STRENGTH, AND CONTROLLED GRADES WHEN MARINES ARE
ALLOWED TO INADVERTENTLY REACH SANCTUARY DUE TO MEDICAL, LEGAL, OR
ACTIVE DUTY PERIOD ACCOUNTING PROBLEMS. PER REF C, THIS POLICY WAS
EXTENDED TO THE ACTIVATION OF RESERVE MARINES IN SUPPORT OF
OPERATION NOBLE EAGLE/ENDURING FREEDOM (ONE/OEF) FOR THE SAME
REASONS. AN INCREASE IN MOBILIZATION TEMPO CREATED A CORRESPONDING
NEED TO MAXIMIZE THE USE OF "VOLUNTEER" RESERVISTS AND INCREASE
FLEXIBILITY TO RETAIN INDIVIDUALS, ON A CASE-BY-CASE BASIS,
REGARDLESS OF SANCTUARY CONCERNS. DC, M&RA APPROVED A REVISED
SANCTUARY POLICY IN JUL O2 THAT DELEGATED APPROVAL AUTHORITY TO
COMMARFORRES FOR ACTIVATING SMCR UNIT MEMBERS BEYOND THE 16-YEAR
MARK. IN JAN 03, DC, M&RA DELEGATED SIMILAR APPROVAL AUTHORITY TO
CMC (MP) TO ACTIVATE OR RETAIN IMA/IRR MARINES BEYOND THE 16-YEAR
MARK.
3. POLICY.
A. ACTIVATION/EXTENSION OF RESERVISTS BEYOND SIXTEEN YEARS OF
ACTIVE SERVICE. ACTIVATION OF MARINES WITH SIXTEEN OR MORE YEARS OF
ACTIVE SERVICE IS AN ADDITIONAL TOOL TO HELP COMMANDERS MEET
INCREASED REQUIREMENTS FROM LIMITED MANPOWER POOLS. HOWEVER,
COMMANDERS ARE REQUESTED TO USE THIS TOOL PRUDENTLY BY ENSURING THAT
THE SERVICES OF THE MARINE ARE ESSENTIAL AND THAT THERE ARE NOT
SIMILARLY QUALIFIED RESERVE MARINES AVAILABLE FOR ACTIVATION WHO
POSSESS FIFTEEN OR LESS YEARS OF ACTIVE SERVICE.
(1) SMCR UNITS. COMMARFORRES WILL CONTINUE TO HAVE APPROVAL
AUTHORITY OVER SMCR UNIT MEMBERS. REF D CONTAINS ADDITIONAL
GUIDANCE.
(2) INDIVIDUALS (IMA/IRR). COMMANDERS CAN REQUEST THE ACTIVATION OR
EXTENSION OF IMA/IRR MARINES VIA THE CHAIN OF COMMAND TO CMC (MP).
MP WILL EVALUATE THESE REQUESTS ON A CASE-BY-CASE BASIS, BALANCING
THE OVERALL OPERATIONAL REQUIREMENTS OF THE COMMANDER AGAINST THE
IMPACT OF RETAINING THESE MARINES UNTIL THEY QUALIFY FOR A REGULAR
RETIREMENT. THE PROCEDURES FOR REQUESTING THE ACTIVATION OR
EXTENSION OF THESE MARINES, ARTICULATED IN REF E, HAVE NOT CHANGED.
B. RESERVISTS IN SANCTUARY. REFERENCE (A) PROHIBITS THE
INVOLUNTARY RELEASE OF A SERVICEMEMBER IN SANCTUARY, AND COMPLIANCE
WITH THIS STATUTORY REQUIREMENT IS A COMMAND RESPONSIBILITY. ONCE A
RESERVIST REACHES EIGHTEEN YEARS OF ACTIVE SERVICE, THE COMMAND WILL
NOTIFY CMC (MP) BY MESSAGE. CMC (MP) WILL MANAGE THIS POPULATION,
COORDINATING THE NECESSARY ACTIVE DUTY ORDERS TO MEET THE SANCTUARY
REQUIREMENTS OF REF A. THE ORDERS PROCESS AND CORRESPONDING
RESPONSIBILITIES ARE OUTLINED BELOW.
(1) TYPE/PRECEDENCE OF ORDERS. ORDERS (MOB, ADSW-CO OR EAD) USED TO
KEEP THE RESERVISTS ON ACTIVE DUTY UNTIL ELIGIBLE FOR A REGULAR
RETIREMENT WILL BE ISSUED IN THE FOLLOWING PRECEDENCE.
(A) EXTENSION OF CURRENT ACTIVATION ORDERS. IF THE RESERVE MEMBER
IS FILLING A VALID INDIVIDUAL AUGMENTATION REQUIREMENT, CMC (MP)
MAY EXTEND THE MARINE'S CURRENT SET OF ACTIVATION ORDERS OUT TO A
TOTAL OF 24 MONTHS OF ACTIVATED SERVICE. CMC (MP) WILL COORDINATE
WITH THE GAINING FORCE COMMAND TO DETERMINE WHETHER AN EXTENSION IS
REQUIRED.
(B) ADSW-CONTINGENCY ORDERS (ADSW-CO). RESERVISTS WHO REACH
SANCTUARY WHILE FUNDING FROM CONGRESSIONALLY APPROVED CONTINGENCY
FUNDS ARE AVAILABLE WILL BE ISSUED ADSW-CO ORDERS BY CMC (MP) WHEN
THEY CAN NO LONGER BE CARRIED ON ACTIVATION ORDERS.
(C) EXTENDED ACTIVE DUTY (EAD) ORDERS. EAD ORDERS WILL BE ISSUED
BY CMC (MM) ONCE CONTINGENCY FUNDS ARE NO LONGER AVAILABLE TO FUND
ADSW-CO ORDERS.
(2) SMCR UNIT MEMBERS. THE MARINE WILL BE RETAINED WITH THE UNIT
FOR THE DURATION OF THE UNIT'S MOBILIZATION. UPON UNIT
DEACTIVATION, THE MARINE WILL BE ISSUED AN ADDITIONAL SET OF
MOBILIZATION, ADSW-CO, OR EAD ORDERS AS OUTLINED ABOVE.
(3) ADSW-CO/EAD ASSIGNMENTS. ASSIGNMENTS WILL BE MADE BASED ON THE
OPERATIONAL REQUIREMENTS OF THE MARINE CORPS. CMC (MP) HAS THE
FINAL DECISION AUTHORITY ON ASSIGNMENTS FOR ADSW-CO ORDERS, WHILE
CMC (MM) HAS THE FINAL DECISION AUTHORITY FOR EAD ORDERS. FOR
MEMBERS FILLING INDIVIDUAL AUGMENTATION BILLETS, GAINING FORCE
COMMANDS MAY REQUEST TO RETAIN THE RESERVIST IN THE CURRENT BILLET.
(4) RETIREMENT. PER REF A, THERE IS NO LEGAL REQUIREMENT TO RETAIN
A RESERVIST ON ACTIVE DUTY ONCE THEY ARE ELIGIBLE FOR A REGULAR
RETIREMENT. RESERVISTS MAY EITHER ACCEPT A REGULAR RETIREMENT OR
REMAIN ON THE RESERVE ACTIVE STATUS LIST (RASL), IF SERVICE
LIMITATIONS PERMIT, AND PURSUE A NON-REGULAR RETIREMENT.
(5) PROMOTIONS. RESERVISTS WHO ARE SELECTED/PROMOTED WHILE
ACTIVATED OR IN SANCTUARY WILL NOT BE RETAINED ON ACTIVE DUTY ONCE
THEY ARE RETIREMENT ELIGIBLE SOLELY FOR THE PURPOSE OF FULFILLING
THE TIME-IN-GRADE REQUIREMENTS MANDATED BY REF F (OFFICERS) OR REF G
(AS IT APPLIES TO ENLISTED ONLY). A RESERVIST WHO DESIRES TO BE
RETIRED AT THEIR HIGHER GRADE MAY PURSUE A NON-REGULAR RETIREMENT IN
THE READY RESERVE.
