RMKS/1. PURPOSE. THIS MARADMIN PROMULGATES POLICY FOR APPLYING
STOP LOSS TO MEMBERS OF THE MARINE CORPS RESERVE. IT SUPERCEDES
PARAGRAPH 4 OF REF A. ADMIN SECTIONS WILL REVIEW THE GUIDANCE
IN THIS DOCUMENT AND ENSURE ALL PREVIOUS STOP LOSS UNIT DIARY
ENTRIES ARE IN COMPLIANCE WITH THE INSTRUCTIONS CONTAINED HEREIN.
ADMIN SECTIONS WILL CONTACT THEIR LOCAL MISSO FOR ASSISTANCE IN
CORRECTING ERRONEOUS STOP LOSS ENTRIES.
2. BACKGROUND. SINCE THE IMPLEMENTATION OF REF A, CONFUSION HAS
EXISTED REGARDING HOW STOP LOSS AFFECTS MEMBERS OF THE MARINE CORPS
RESERVE. THIS MARADMIN, WHICH IS APPLICABLE ONLY TO MEMBERS OF THE
RESERVE COMPONENT, SEEKS TO DISPEL THIS CONFUSION BY DETAILING HOW
STOP LOSS IS APPLIED TO RESERVISTS.
3. RESERVE STOP LOSS APPLICABILITY. STOP LOSS IS APPLICABLE TO
MEMBERS OF THE READY RESERVE (SMCR, IMA, IRR, AND AR) AND THOSE
MEMBERS OF THE RETIRED RESERVE INVOLUNTARILY RECALLED TO ACTIVE DUTY.
MARINES IN THESE CATEGORIES ARE SUBJECT TO STOP LOSS UNLESS THEY ARE
SPECIFICALLY EXEMPTED BY THIS MARADMIN OR THE FIRST GENERAL OFFICER
IN THEIR CHAIN OF COMMAND (HEREAFTER REFERED TO AS THE FIRST GO).
STOP LOSS DOES NOT APPLY TO MARINES LISTED IN PARAGRAPHS 3A OR 3C
BELOW, MEMBERS OF THE STANDBY RESERVE, AND MARINES PERFORMING ADSW,
AT, OR ON THE RESERVE EAD RECRUITING PROGRAM. FURTHER, COMMANDERS ARE
NOT AUTHORIZED TO USE STOP LOSS IN LIEU OF PROCESSING REENLISTMENTS.
A. MANDATORY SEPARATION AND RETIREMENT. COMMANDERS WILL CONTINUE TO
PROCESS MARINES FACING MANDATORY SEPARATION OR RETIREMENT. COMMANDS
MAY REQUEST THE EXTENSION OF A MARINE BEYOND THEIR MANDATORY
SEPARATION/RETIREMENT DATE IF THE MARINE CONSENTS TO THE REQUEST AND
THERE IS AN OPERATIONAL REQUIREMENT FOR HIS SERVICES. REQUESTS WILL
BE SUBMITTED VIA THE CHAIN OF COMMAND TO CMC (MMSR) FOR APPROVAL.
ACTIVATED RESERVISTS MUST BE RELEASED FROM ACTIVE DUTY NO LESS THAN 15
DAYS PRIOR TO THEIR MANDATORY SEPARATION OR RETIREMENT DATE.
B. VOLUNTARY REENLISTMENT/EXTENSION. COMMANDS WILL NOT STOP LOSS
RESERVISTS WHO ARE APPROVED FOR VOLUNTARY REENLISTMENT OR EXTENSION.
COMMANDS WILL STOP LOSS RESERVISTS WITHIN 90 DAYS PRIOR TO THEIR
SEPARATION DATE WHO ARE UNWILLING OR HAVE DECLINED REENLISTMENT/
EXTENSION. COMMANDS MAY STOP LOSS RESERVISTS WHO HAVE BEEN DENIED
VOLUNTARY REENLISTMENT/EXTENSION IF AN OPERATIONAL REQUIREMENT EXISTS.
C. ADMINISTRATIVE SEPARATION. COMMANDS WILL CONTINUE TO
ADMINISTRATIVELY SEPARATE MARINES IAW REF D.
4. STOP LOSS PROCESS. WITHIN THE PARAMETERS OF PARAGRAPH 3B ABOVE,
MARINES ARE STOP LOSSED AS FOLLOWS:
A. DRILLING RESERVISTS (SMCR/IMA).
(1) OBLIGORS. OBLIGORS ARE THOSE DRILLING RESERVISTS WHO HAVE NOT YET
REACHED THEIR MANDATORY DRILL PARTICIPATION STOP DATE (MDPSD). THEY
CANNOT VOLUNTARILY TRANSFER OR RESIGN. ONCE PAST THEIR MDPSD THEY
BECOME NON-OBLIGORS AND ARE THEN SUBJECT TO STOP LOSS ACCORDING TO THE
PROCEDURES OUTLINED HEREIN.
(2) NON-OBLIGORS. NON-OBLIGORS WILL BE STOP LOSSED NO EARLIER THAN 90
DAYS PRIOR TO THEIR RECC. UNITS WILL RUN TTC 081 001 AND TTC 119 000.
B. IRR (NOT ACTIVATED). MCRSC WILL RUN TTC 081 001 AND 119 000 TO
STOP LOSS MEMBERS OF THE IRR 90 DAYS PRIOR TO THEIR RECC.
C. ACTIVATED RESERVISTS (SMCR, IMA, IRR). ACTIVATED RESERVISTS WILL
BE STOP LOSSED NO EARLIER THAN 90 DAYS PRIOR TO THEIR RECC, NOT THEIR
EAS. UNITS WILL RUN TTC 081 001 AND 119 000. STOP LOSS DOES NOT
AUTOMATICALLY EXTEND AN ACTIVATED RESERVIST BEYOND THEIR EAS
(EXCEPTION: SMCR MARINES ARE AUTOMATICALLY EXTENDED IF THEIR UNIT'S
TERM OF ACTIVATION IS EXTENDED). GAINING FORCE COMMANDS (GFC) MUST
REQUEST THE EXTENSIONS OF IMA'S AND IRR'S IAW WITH REF B. EXTENSIONS
WILL ONLY BE CONSIDERED IF THE RESERVIST IS WITHIN 90 DAYS PRIOR TO
THEIR EAS. ONCE AN EXTENSION IS GRANTED, THE RESERVIST'S ORDERS MUST
BE MODIFIED TO REFLECT THEIR NEW EAS. SMCR UNITS WILL MODIFY SMCR
ORDERS. MCRSC WILL MODIFY IMA/IRR ORDERS. REGARDLESS OF STOP LOSS,
RESERVISTS WILL NOT REMAIN ACTIVATED IN SUPPORT OF A NAMED CONTINGENCY
OPERATION BEYOND A TOTAL OF 24 MONTHS.
D. AR MARINES AND RESERVE OFFICERS ON THEIR INITAL ACTIVE DUTY
OBLIGATION. AR ENLISTED MARINES, AR OFFICERS WHO HAVE NOT YET BEEN
CAREER DESIGNATED, AND THOSE RESERVE OFFICERS ON THEIR INITIAL ACTIVE
DUTY OBLIGATION WILL BE STOP LOSSED NO EARLIER THAN 90 DAYS PRIOR TO
THEIR EAS. UNITS WILL RUN TTC 081 000 AND TTC 119 000.
E. RETIREES RECALLED TO ACTIVE DUTY UNDER 10 US CODE SECTION 688.
RETIREES DO NOT HAVE AN RECC, ONLY AN EAS. GFC'S MAY REQUEST TO
INVOLUNTARILY EXTEND A RETIREE BEYOND THEIR INITIAL EAS IAW REF E.
ONCE APPROVED BY MPP-60, THE RETIREE IS STOP LOSSED. THE GFC WILL
RUN TTC 081 000 AND 119 000. CMC (MMSR) WILL MODIFY THE RETIREE'S
EAS.
F. TRANSFERS TO THE IRR, INTERSERVICE TRANSFERS, AND REQUESTS FOR
RETIREMENT OR RESIGNATION. RESERVISTS MAY CONTINUE TO REQUEST
TRANSFER, RETIREMENT OR RESIGNATION. ALL REQUESTS REQUIRE THE
APPROVAL OF THE FIRST GO.
(1) THOSE REQUESTS THAT RECEIVE FIRST GO APPROVAL WILL BE PROCESSED
IAW REF'S C AND D AND, UNLESS OTHERWISE DIRECTED BY CMC (RA), MCRSC
WILL CONTINUE TO PROCESS INTERSERVICE TRANSFER REQUESTS PER THE
PROCEDURES UTILIZED PRIOR TO THE IMPLEMENTATION OF STOP LOSS.
(2) IN CASES WHERE THE FIRST GO DISAPPROVES A REQUEST, UNITS WILL
RUN TTC 119 000. TTC 081 001 SHOULD NOT BE RUN UNTIL THE RESERVIST IS
WITHIN 90 DAYS PRIOR TO THEIR RECC.
5. STOP LOSS EXAMPLES. THERE ARE MANY SITUATIONS IN WHICH A MARINE
IS SUBJECT TO STOP LOSS. HERE ARE TWO EXAMPLES THAT DEMONSTRATE THE
PRACTICAL APPLICATION OF STOP LOSS.
(1) SSGT SMITH IS A MEMBER OF AN SMCR UNIT THAT IS NOT CURRENTLY
ACTIVATED. SMITH IS A NON-OBLIGOR AND HIS RECC IS 1 AUG 03. ON 1 MAR
03, HE REQUESTS TRANSFER TO THE IRR. THIS REQUEST IS DISAPPROVED ON 1
APR 03 BY THE FIRST GO IN HIS CHAIN OF COMMAND. HIS ADMIN SECTION
WILL RUN TTC 119 000 IN MCTFS TO INDICATE THAT HIS REQUEST WAS DENIED.
SUBSEQUENTLY ON 1 MAY 2003 (90 DAYS PRIOR TO HIS RECC), HIS ADMIN
SECTION WILL RUN TTC 081 001 TO STOP LOSS HIM. SSGT SMITH'S NEW RECC
IS NOW 1 AUG 2004.
(2) SGT JONES' WAS ACTIVATED ON 1 JUN 2002. JONES, A NON-OBLIGOR IRR,
HAS A RECC OF 1 MAY 2003. THIS MEANS THAT SGT JONES
CAN ONLY REMAIN ACTIVATED FOR 11 MONTHS. HOWEVER, ON 1 FEB 2003, SGT
JONES' GFC STOP LOSSES HIM BY RUNNING TTC'S 081 001 AND 119 000. THIS
ESTABLISHES A NEW RECC OF 1 MAY 2004. SUBSEQUENTLY, THE GFC
DETERMINES AN OPERATIONAL REQUIREMENT EXISTS TO EXTEND HIS PERIOD OF
ACTIVATION FOR A SECOND YEAR. THE GFC SUBMITS A REQUEST ON
15 APR 2003 TO CMC(MPP-60) WHICH IS APPROVED. SINCE SGT JONES' NEW
RECC IS 1 MAY 2004, HE CAN ONLY BE EXTENDED ON ACTIVATION ORDERS
UP TO THAT DATE. MCRSC THEN MODIFIES THE RESERVIST'S ACTIVATION
ORDERS TO REFLECT THE NEW EAS OF 1 MAY 2004.//
