GENTEXT/REMARKS/1.  THIS MARADMIN CONSOLIDATES AND COLLECTIVELY CANCELS REFS (A) - (C) AND PROVIDES UPDATED GUIDANCE REGARDING THE TRANSFER OF POST 9-11 GI BILL EDUCATIONAL BENEFITS. INFORMATION CONTAINED IN REF (A) CONCERNING THE POST 9-11 GI BILL ITSELF, ELIGIBILITY, AND BENEFITS HAS BEEN INCORPORATED INTO REF (D).
2.  GENERAL INFORMATION.  UNDER THE POST 9-11 GI BILL, WHICH BECAME EFFECTIVE ON 1 AUGUST 2009, MARINES MAY USE THE EDUCATIONAL BENEFIT THEMSELVES AND/OR MAY BE PERMITTED TO TRANSFER ALL, OR A PORTION OF, THEIR UNUSED ENTITLEMENT TO SUCH EDUCATIONAL ASSISTANCE TO ONE OR MORE OF THEIR ELIGIBLE DEPENDENTS IN RETURN FOR AGREEING TO AN ADDITIONAL SERVICE COMMITMENT IN THE ARMED FORCES (ACTIVE DUTYAND/OR SELECTED RESERVE (SELRES)). TEB IS NOT AN ENTITLEMENT AND MAY NOT BE AUTHORIZED FOR ANY PURPOSE OTHER THAN PROMOTING RECRUITING AND RETENTION.
    A.  ELIGIBLE INDIVIDUALS. INDIVIDUALS WHO MEET THE FOLLOWING CRITERIA MAY ELECT TO TRANSFER ALL, OR A PORTION OF, THEIR UNUSED POST 9-11 GI BILL EDUCATIONAL BENEFITS:
        (1) MUST, AT THE TIME OF THE ELECTION, BE ELIGIBLE TO RECEIVE EDUCATIONAL ASSISTANCE UNDER THE POST 9-11 GI BILL; AND
        (2) MUST, AT THE TIME OF THE ELECTION, HAVE SERVED AT LEAST SIX (6) YEARS IN THE ARMED FORCES (ACTIVE DUTY AND/OR SELRES) AND AGREE TO SERVE FOUR (4) ADDITIONAL YEARS (ACTIVE DUTY AND/OR SELRES) FROM THE DATE OF THE ELECTION; OR
 (3) MUST, AT THE TIME OF THE ELECTION, HAVE SERVED TEN (10) OR MORE YEARS IN THE ARMED FORCES (ACTIVE DUTY AND/OR SELRES) AND AGREE TO SERVE FOUR (4) ADDITIONAL YEARS (ACTIVE DUTY AND/OR SELRES) FROM THE DATE OF ELECTION. THOSE WHO ARE INVOLUNTARILY RESTRICTED BY MARINE CORPS POLICY, DOD POLICY, OR FEDERAL STATUTE FROM COMMITTING TO FOUR (4) ADDITIONAL YEARS MUST AGREE TO SERVE FOR THE MAXIMUM AMOUNT OF TIME ALLOWED BY SUCH POLICY OR STATUTE.
    B.  ELIGIBLE DEPENDENTS.  INDIVIDUALS WHO ARE ELIGIBLE TO TRANSFER UNUSED POST 9-11 GI BILL EDUCATIONAL BENEFITS MAY TRANSFER SUCH BENEFITS TO THEIR SPOUSE, ONE OR MORE OF THEIR CHILDREN, OR A COMBINATION OF BOTH.
        (1) FOR THE PURPOSES OF THIS PROVISION, THE DEFINITIONS OF SPOUSE AND CHILD ARE CODIFIED IN SECTION 101 OF TITLE 38, UNITED STATES CODE (USC). IN GENERAL, A CHILD WHO IS 18 YEARS OF AGE OR OLDER, AT THE TIME OF THE MEMBER'S ELECTION, CANNOT BE DESIGNATED AS A TRANSFEREE, UNLESS:
            (A) THE CHILD IS REPORTED IN THE DEFENSE ELIGIBILITY ENROLLMENT REPORTING SYSTEM (DEERS) AND ELIGIBLE TO RECEIVE OTHER AUTHORIZED BENEFITS AND ENTITLEMENTS; OR
            (B) THE CHILD IS PURSUING A COURSE OF INSTRUCTION AT AN APPROVED EDUCATIONAL INSTITUTION. IN THIS CASE, THE CHILD MAY BE DESIGNATED AS A TRANSFEREE AT ANY TIME UNTIL COMPLETION OF SUCH EDUCATION/TRAINING OR UNTIL REACHING THE AGE OF 23.
        (2) DEERS IS USED TO CONFIRM DEPENDENT ELIGIBILITY.
            (A) ONLY CURRENT SPOUSES ARE ELIGIBLE.
            (B) THE LEGISLATION THAT CREATED THE TRICARE YOUNG ADULT (TYA) PROGRAM, WHICH EXTENDED HEALTHCARE BENEFITS TO CHILDREN AGE 23 AND OLDER, DID NOT ALTER THE AGE/ELIGIBILITY CRITERIA FOR TRANSFERRING POST 9-11 GI BILL EDUCATIONAL BENEFITS. CHILDREN, AGE 23 AND OLDER, ARE NOT ELIGIBLE TRANSFEREES REGARDLESS OF THEIR ENROLLMENT IN TYA.
    C.  MARINES MUST USE THE DEFENSE MANPOWER DATA CENTER (DMDC) TEB WEB APPLICATION, WWW.DMDC.OSD.MIL/MILCONNECT/, WHEN ELECTING TO TRANSFER POST 9-11 GI BILL EDUCATIONAL BENEFITS. TEB REQUESTS SUBMITTED VIA ANY OTHER MEANS (E.G., DEPARTMENT OF VETERANS AFFAIRS' (DVA) FORMS, DVA WEBSITE, STATEMENTS OF UNDERSTANDING, ETC.) DO NOT CONSITITUTE OFFICIAL REQUESTS TO TRANSFER POST 9-11 GI BILL EDUCATIONAL BENEFITS AND WILL NOT BE RECOGNIZED.
    D.  IN THE CASE OF MEMBERS OF THE RESERVE COMPONENTS OF THE ARMED FORCES, ACTIVE DUTY MEANS SERVICE ON ACTIVE DUTY UNDER A CALL OR ORDER TO ACTIVE DUTY UNDER SECTION 688, 12301(A), 12301(D), 12301(G), 12302, OR 12304 OF TITLE 10 USC OR SECTION 712 OF TITLE 14 USC.
    E.  FOR THE PURPOSES OF THIS MARADMIN AND THE TRANSFER OF POST 9-11 GI BILL EDUCATIONAL BENEFITS, THE TERM ARMED FORCES MEANS ACTIVE DUTY OR SELRES.  IT DOES NOT INCLUDE THE INDIVIDUAL READY RESERVE (IRR).
    F.  FOR THE PURPOSES OF THIS MARADMIN AND THE TRANSFER OF POST 9-11 GI BILL EDUCATIONAL BENEFITS, SELRES INCLUDES: MEMBERS OF SELECTED MARINE CORPS RESERVE (SMCR) UNITS, INDIVIDUAL MOBLIZATION AUGMENTEES (IMA), AND MEMBERS OF THE ACTIVE RESERVE (AR). IT DOES NOT INCLUDE THE IRR.
3.  TIME FOR TRANSFER, REVOCATION, OR MODIFICATION
    A.  TIME FOR TRANSFER.  PER REFS (E) - (F), MARINES MAY ONLY REQUEST TO TRANSFER THEIR UNUSED POST 9-11 GI BILL EDUCATIONAL BENEFITS WHILE SERVING ON ACTIVE DUTY OR IN THE SELRES.
        (1) ACTIVE DUTY MARINES WHO SEPARATED, RETIRED, TRANSFERRED TO THE FLEET RESERVE OR WERE DISCHARGED PRIOR TO 1 AUGUST 2009 ARE NOT ELIGIBLE TO TRANSFER THEIR POST 9-11 GI BILL EDUCATIONAL BENEFITS.
        (2) MEMBERS OF THE SELRES WHO TRANSFERRED TO THE RETIRED RESERVE (WITH OR WITHOUT PAY), TRANSFERRED TO THE IRR, OR WERE DISCHARGED PRIOR TO 1 AUGUST 2009 ARE NOT ELIGIBLE TO TRANSFER THEIR POST 9-11 GI BILL EDUCATIONAL BENEFITS.
    B.  REVOCATION AND MODIFICATION. MARINES WHO ELECT TO TRANSFER THEIR POST 9-11 GI BILL EDUCATIONAL BENEFITS MAY MODIFY (I.E.,CHANGE BENEFIT ALLOCATION/DISTRIBUTION) OR REVOKE TRANSFERS OF ENTITLEMENT, ONCE APPROVED, AT ANY TIME. WHILE IN THE ARMED FORCES, ADDITIONS, MODIFICATIONS, OR REVOCATIONS OF APPROVED TRANSFERS OF ENTITLEMENT WILL BE MADE BY THE MEMBER THROUGH THE DMDC TEB WEB APPLICATION. ONCE SEPARATED, RETIRED, TRANSFERRED TO THE IRR, OR DISCHARGED FROM THE ARMED FORCES, INDIVIDUALS MAY MODIFY OR REVOKE APPROVED TRANSFERRED ENTITLEMENT FOR PREVIOUSLY DESIGNATED DEPENDENTS BY SUBMITTING A WRITTEN REQUEST TO THE DVA.
        (1) PROHIBITION AGAINST ADDING DEPENDENTS. INDIVIDUALS MAY NOT DESIGNATE NEW TRANSFEREES ONCE SEPARATED, RETIRED, OR DISCHARGED FROM THE ARMED FORCES; THIS IS CONSIDERED ADDING A DEPENDENT AND IS PROHIBITED.
        (2) MARINES ELECTING TO TRANSFER EDUCATIONAL BENEFITS ARE ENCOURAGED TO ALLOCATE AT LEAST ONE (1) MONTH OF BENEFIT TO EACH ELIGIBLE DEPENDENT PRIOR TO SEPARATING FROM THE ARMED FORCES IN ORDER TO AVOID CHALLENGES ASSOCIATED WITH UNINTENTIONALLY CONFLICTING WITH THE PROHIBITION AGAINST ADDING DEPENDENTS.
4.  DEPENDENT USE OF TRANSFERRED BENEFITS. PRIOR TO USING TRANSFERRED BENEFITS, DEPENDENTS MUST REQUEST A CERTIFICATE OF ELIGIBILITY (COE) FROM THE DVA BY COMPLETING VA FORM 22-1990E, WHICH IS AVAILABLE THROUGH THE DVA'S VETERANS ON-LINE APPLICATION (VONAPP) WEBSITE, HTTP:(SLASHSLASH)VABENEFITS.VBA.VA.GOV/VONAPP/ MAIN.ASP.  DEPENDENT USE OF TRANSFERRED EDUCATIONAL BENEFITS IS SUBJECT TO THE FOLLOWING:
    A.  A SPOUSE:
        (1) MAY START TO USE TRANSFERRED BENEFITS IMMEDIATELY.
        (2) ENTITLEMENT TO USE TRANSFERRED EDUCATIONAL BENEFITS EXPIRES AT THE END OF A 15-YEAR PERIOD, WHICH BEGINS ON THE MEMBER'S LAST DATE OF DISCHARGE OR RELEASE FROM ACTIVE DUTY OF AT LEAST 90 CONSECUTIVE DAYS.
    B.  A CHILD:
        (1) MAY START TO USE TRANSFERRED BENEFITS ONLY AFTER THE MEMBER HAS COMPLETED AT LEAST TEN (10) YEARS OF SERVICE IN THE ARMED FORCES.
        (2) MAY NOT USE TRANSFERRED BENEFITS UNTIL THEY HAVE MET THE REQUIREMENTS OF A SECONDARY SCHOOL DIPLOMA (OR EQUIVALANCY CERTIFICATE), OR REACHED 18 YEARS OF AGE.
        (3) IS NOT SUBJECT TO THE 15-YEAR TIME LIMITATION, BUT MAY NOT USE BENEFITS AFTER REACHING 26 YEARS OF AGE.
5.  ORGANIZATIONAL ROLES AND RESPONSIBILITIES:
    A.  MANPOWER MANAGEMENT ENLISTED ASSIGNMENTS (MMEA-6) IS THE INITIAL POINT OF CONTACT FOR ALL ACTIVE COMPONENT ENLISTED MARINE TEB MATTERS AND SERVES AS THE SUBJECT MATTER EXPERT (SME) FOR BENEFIT ELIGIBILITY AND TRANSFERABILITY REQUIREMENTS FOR ACTIVE COMPONENT ENLISTED MARINES.
    B.  MANPOWER MANAGEMENT OFFICER ASSIGNMENTS (MMOA-3) IS THE INITIAL POINT OF CONTACT FOR ALL ACTIVE COMPONENT OFFICER TEB MATTERS AND SERVES AS THE SME FOR BENEFIT ELIGIBILITY AND TRANSFERABILITY REQUIREMENTS FOR ACTIVE COMPONENT OFFICERS.
    C.  RESERVE AFFAIRS - RESERVE CONTINUATION AND TRANSITION BRANCH (RA-RCT) IS THE INITIAL POINT OF CONTACT AND SME FOR ALL POST 9-11 GI BILL MATTERS FOR OFFICER AND ENLISTED RESERVE COMPONENT MARINES.
    D.  THE MILITARY POLICY OFFICE (MPO) IS RESPONSIBLE FOR THE POST 9-11 GI BILL POLICY, ASSISTING IN TEB DETERMINATIONS, AND MONITORING TEB EXECUTION.
6.  PROCEDURES FOR REQUESTING TO TRANSFER EDUCATIONAL BENEFITS:
    A.  ACTIVE COMPONENT ENLISTED MARINES:
        (1) MARINE VERIFIES DEPENDENT INFORMATION REPORTED IN DEERS.
        (2) MARINE SPEAKS WITH THEIR UNIT CAREER PLANNER ABOUT ELIGIBILITY CRITERIA FOR TRANSFER, ADDITIONAL OBLIGATED SERVICE REQUIREMENTS, RE-ENLISTMENT AND ENLISTMENT EXTENSION OPTIONS, AND FORMS REQUIRED FOR TEB APPROVAL.
        (3) MARINE ELECTS TO TRANSFER UNUSED EDUCATIONAL BENEFITS THROUGH THE DMDC TEB WEB APPLICATION, CONCURRENT WITH A SUBMISSION OF A REENLISTMENT/EXTENSION (IF ADDITIONAL OBLIGATED SERVICE IS REQUIRED) REQUEST TO CMC (MMEA-6) AS PRESCRIBED IN MCO 1040.31 (ENLISTED RETENTION AND CAREER DEVELOPMENT PROGRAM). CAREER PLANNER SPECIFIES THAT THE REQUEST IS SUBMITTED, "FOR PURPOSES OF ESTABLISHING REQUIRED OBLIGATED SERVICE FOR ELIGIBILITY TO TRANSFER UNUSED EDUCATIONAL BENEFITS UNDER THE POST 9-11 GI BILL."
        (4) MARINE, IN COORDINATION WITH HIS OR HER COMMAND, COMPLETES THE STATEMENT OF UNDERSTANDING (SOU) AND SUBMITS IT TO CMC (MMSB) FOR INCLUSION IN THE MARINE'S OFFICIAL MILITARY PERSONNEL FILE (OMPF).
        (5) CMC (MMEA-6) REVIEWS THE MARINE'S TEB APPLICATION. THE REENLISTMENT, EXTENSION, AND LATERAL MOVE (RELM) REQUEST IS FORWARDED TO CMC (MMEA-6) VIA THE TOTAL FORCE RETENTION SYSTEM (TFRS).
        (6) TFRS RELM PACKAGES AND TEB REQUESTS ARE REVIEWED AND DECIDED (CONCURRENTLY) BY CMC (MMEA-6).  IF THE TEB REQUEST IS APPROVED, THE OBLIGATED SERVICE END DATE WILL BE CALCULATED FROM THE DATE THE REQUEST WAS SUBMITTED THROUGH THE DMDC TEB WEB APPLICATION. MARINES WILL HAVE 60 DAYS FROM THE DMDC TEB WEB APPLICATION DATE TO INCUR THE REQUIRED OBLIGATED SERVICE (I.E., FOUR (4) YEARS FROM THE DMDC TEB WEB APPLICATION DATE) OR THE TEB REQUEST WILL BE REJECTED.
        (7) MARINE PROVIDES A COPY OF HIS OR HER TEB APPROVAL LETTER TO THEIR ADMINISTRATIVE SUPPORT CENTER IN ORDER TO EFFECT THE APPROPRIATE ENTRY WITHIN THE MARINE CORPS TOTAL FORCE SYSTEM (MCTFS) INDICATING TRANSFER OF POST 9-11 GI BILL BENEFITS.
    B.  PROCEDURES FOR ACTIVE COMPONENT OFFICERS:
        (1) OFFICER VERIFIES DEPENDENT INFORMATION REPORTED IN DEERS.
        (2) OFFICER ELECTS TO TRANSFER UNUSED EDUCATIONAL BENEFITS THROUGH THE DMDC TEB WEB APPLICATION.
        (3) OFFICER, IN COORDINATION WITH HIS OR HER COMMAND, COMPLETES THE SOU AND SUBMITS IT TO CMC (MMSB) FOR INCLUSION IN THE OFFICER'S OMPF.
        (4) CMC (MMOA-3) REVIEWS THE OFFICER'S TEB APPLICATION.
        (5) CMC (MMOA-3) VERIFIES THE MARINE HAS SERVED THE MINIMUM INITIAL OBLIGATION, HAS BEEN CAREER DESIGNATED OR APPROVED FOR PARTICIPATION IN THE ACTIVE COMPONENT TO SELECTED MARINE CORPS RESERVE DIRECT AFFILIATION PROGRAM, AND IS ELIGIBLE TO TRANSFER EDUCATIONAL BENEFITS.
        (6) CMC (MMOA-3) ENTERS THE MINIMUM REQUIRED SERVICE OBLIGATION INTO THE TEB SYSTEM AND APPROVES THE TEB REQUEST, OR
        (7) REJECTS (I.E., DISAPPROVES) THE REQUEST WHILE ENTERING THE APPROPRIATE REJECTION CODE.
        (8) IF APPROVED, OFFICER PROVIDES A COPY OF HIS OR HER TEB APPROVAL LETTER TO THEIR ADMINISTRATIVE SUPPORT CENTER IN ORDER TO EFFECT THE APPROPRIATE ENTRY WITHIN MCTFS INDICATING TRANSFER OF POST 9-11 GI BILL BENEFITS.
    C.  PROCEDURES FOR RESERVE COMPONENT ENLISTED MARINES:
        (1) MARINE VERIFIES DEPENDENT INFORMATION REPORTED IN DEERS.
        (2) MARINE SPEAKS WITH THEIR UNIT CAREER PLANNER ABOUT ELIGIBILITY CRITERIA FOR TRANSFER, ADDITIONAL OBLIGATED SERVICE REQUIREMENTS, RE-ENLISTMENT/ENLISTMENT EXTENSION OPTIONS, AND FORMS REQUIRED FOR TEB APPROVAL.
        (3) MARINE ELECTS TO TRANSFER UNUSED EDUCATIONAL BENEFITS THROUGH THE DMDC TEB WEB APPLICATION, CONCURRENT WITH A SUBMISSION OF A REENLISTMENT/EXTENSION (IF ADDITIONAL OBLIGATED SERVICE IS REQUIRED) REQUEST TO CMC (RA-RCT) AS PRESCRIBED IN MCO 1040R.35 (RESERVE CAREER RETENTION AND DEVELOPMENT MANUAL). CAREER PLANNER SPECIFIES THAT THE REQUEST IS SUBMITTED, "FOR PURPOSES OF ESTABLISHING REQUIRED OBLIGATED SERVICE FOR ELIGIBILITY TO TRANSFER UNUSED EDUCATIONAL BENEFITS UNDER THE POST 9-11 GI BILL."
        (4)  MARINE, IN COORDINATION WITH HIS OR HER COMMAND, COMPLETES THE SOU AND SUBMITS IT TO CMC (MMSB) FOR INCLUSION IN THE MARINE'S OMPF.
        (5) CMC (RA-RCT) REVIEWS THE MARINE'S TEB APPLICATION. THE RELM REQUEST IS FORWARDED TO CMC (RA-RCT) VIA TFRS.
        (6) TFRS RELM PACKAGES AND TEB REQUESTS ARE REVIEWED AND DECIDED (CONCURRENTLY) BY CMC (RA-RCT). IF THE TEB REQUEST IS APPROVED, THE OBLIGATED SERVICE END DATE WILL BE THE PROJECTED NEW RESERVE END OF CURRENT CONTRACT (ECC) DATE. MARINES WILL HAVE 60 DAYS FROM THE DMDC TEB WEB APPLICATION DATE TO INCUR THE REQUIRED OBLIGATED SERVICE (I.E., FOUR (4) YEARS FROM THE DMDC TEB WEB APPLICATION DATE) OR THE TEB REQUEST WILL BE REJECTED.
        (7) IF APPROVED, MARINE PROVIDES A COPY OF HIS OR HER TEB APPROVAL LETTER TO THEIR ADMINISTRATIVE SUPPORT CENTER IN ORDER TO EFFECT THE APPROPRIATE ENTRY WITHIN MCTFS INDICATING TRANSFER OF POST 9-11 GI BILL BENEFITS.
    D.  PROCEDURES FOR RESERVE COMPONENT OFFICERS:
        (1) OFFICER VERIFIES DEPENDENT INFORMATION REPORTED IN DEERS.
        (2) OFFICER ELECTS TO TRANSFER UNUSED EDUCATIONAL BENEFITS THROUGH THE DMDC TEB WEB APPLICATION.
        (3) OFFICER, IN COORDINATION WITH HIS OR HER COMMAND, COMPLETES THE SOU AND SUBMITS IT TO CMC (MMSB) FOR INCLUSION IN THE OFFICER'S OMPF.
        (4) CMC (RA-RCT) REVIEWS THE OFFICER'S TEB APPLICATION BY VERIFYING THE OFFICER HAS SERVED THE MINIMUM INITIAL OBLIGATION AND IS ELIGIBLE TO TRANSFER EDUCATIONAL BENEFITS.
        (5) CMC (RA-RCT) ENTERS OBLIGATED SERVICE COMITTMENT AND APPROVES THE TEB REQUEST, OR
        (7) REJECTS (I.E., DISAPPROVES) THE REQUEST WHILE ENTERING THE APPROPRIATE REJECTION CODE.
        (8) IF APPROVED, OFFICER PROVIDES A COPY OF THE TEB APPROVAL LETTER TO THEIR ADMINISTRATIVE SUPPORT CENTER IN ORDER TO EFFECT THE APPROPRIATE ENTRY WITHIN MCTFS INDICATING TRANSFER OF POST 9-11 GI BILL BENEFITS.
7.  ADDITIONAL ADMINISTRATIVE MATTERS:
    A.  MARINES WHO ARE ELIGIBLE TO RECEIVE EDUCATIONAL ASSISTANCE UNDER MULTIPLE BENEFIT PROGRAMS (E.G., POST 9-11 GI BILL, MGIB-AD, MGIB-SR, REAP, ETC.) WILL BE REQUIRED TO MAKE AN IRREVOCABLE DECISION TO CONVERT TO (I.E., USE) THE POST 9-11 GI BILL WHEN ELECTING TO TRANSFER UNUSED POST 9-11 GI BILL EDUCATIONAL BENEFITS.
    B.  AN INDIVIDUAL TRANSFERRING POST 9-11 GI BILL ENTITLEMENT MUST DESIGNATE THE ELIGIBLE DEPENDENT(S), THE NUMBER OF MONTHS OF ENTITLEMENT TO BE TRANSFERRED AND SPECIFY THE PERIOD OF USE. THE NUMBER OF MONTHS TRANSFERRED MAY NOT EXCEED THE LESSER OF THE MONTHS OF UNUSED ENTITLEMENT AVAILABLE UNDER THE POST 9-11 GI BILL, 6 MONTHS OR THE NUMBER OF MONTHS SPECIFIED BY DOD.
    C.  APPROVAL OF TEB REQUESTS SHOULD NOT BE ASSUMED. MARINES MUST PERIODICALLY CHECK THE DMDC TEB WEB APPLICATION TO VIEW THE STATUS OF TEB REQUESTS.
       (1) IF APPROVED, AN AUTO-GENERATED APPROVAL LETTER, WHICH SHALL BE MAINTAINED BY THE MEMBER, WILL APPEAR WITHIN DMDC TEB WEB APPLICATION.
       (2) IF REJECTED (I.E., DISAPPROVED), MARINES SHOULD DETERMINE THE REASON FOR THE REJECTION BY REFERRING TO THE REJECTION CODES PROVIDED AND TAKE APPROPRIATE, CORRECTIVE ACTION AND REAPPLY, IF DESIRED.  TEB REQUESTS ARE GENERALLY REJECTED FOR THE FOLLOWING REASONS:
           (A) ENLISTED MARINES WHO DO NOT HAVE (4) YEARS (I.E., OBLIGATED SERVICE REQUIRED FOR TRANSFERRING POST 9-11 GI BILL BENEFITS) REMAINING ON THEIR CURRENT CONTRACT AND FAIL TO GAIN, THROUGH REENLISTMENT/EXTENSION, THE NECESSARY OBLIGATED SERVICE WITHIN (60) DAYS OF THEIR TEB REQUEST.
           (B) MARINES WHO CANNOT INCUR THE REQUIRED, ADDITIONAL OBLIGATED SERVICE (I.E., 4 YEARS FROM THE DATE OF THE DMDC TEB WEB APPLICATION DATE) DUE TO AN APPROVED VOLUNTARY RETIREMENT OR SEPARATION DATE.
    D.  OBLIGATED SERVICE POLICIES:
        (1) THE SERVICE OBLIGATION INCURRED FOR TRANSFERING POST 9-11 GI BILL EDUCATIONAL BENEFITS RUNS CONCURRENT WITH SERVICE OBLIGATIONS INCURRED FOR ANY OTHER PURPOSE (E.G., PROFESSIONAL MILITARY EDUCATION PAYBACK, PERMANENT CHANGE OF STATION REASSIGNMENT, REGULAR REENLISTMENT).
        (2) THE SERVICE OBLIGATION INCURRED FOR TRANSFERING POST 9-11 GI BILL EDUCATIONAL BENEFITS BEGINS ON THE REQUEST DATE OF THE SERVICE MEMBER'S APPROVED TEB WEB APPLICATION, BUT CAN BE NO EARLIER THAN 1 AUGUST 2009. IF A MEMBER'S INITIAL TEB REQUEST IS REJECTED (I.E., DISAPPROVED), HE OR SHE MAY RE-APPLY. HOWEVER, SUBSEQUENT REQUESTS WILL BE AUTOMATICALLY ASSIGNED A NEW TEB REQUEST TRANSFER DATE, WHICH RESTARTS THE TIMELINE FOR REQUIRED OBLIGATED SERVICE.
        (3) FAILURE TO COMPLETE ADDITIONAL OBLIGATED SERVICE AGREEMENT.  ANY AMOUNT OF TRANSFERRED ENTITLEMENT THAT IS USED BY A DEPENDENT(S) OF A MEMBER WHO FAILS TO COMPLETE THE AGREED UPON ADDITIONAL OBLIGATED SERVICE SHALL BE TREATED AS AN OVERPAYMENT OF EDUCATIONAL ASSISTANCE AND SUBJECT TO COLLECTION BY THE DVA. IN THESE CASES, MEMBERS RETAIN THEIR ELIGIBILITY TO RECEIVE EDUCATIONAL ASSISTANCE UNDER THE POST 9-11 GI BILL, BUT FORFEIT TRANSFER ELIGIBILITY.  SUBPARAGRAPH 7.D.(3) OF THIS MARADMIN DOES NOT APPLY TO INDIVIDUALS WHO FAIL TO COMPLETE THEIR ADDITIONAL OBLIGATED SERVICE AGREEMENT DUE TO:
            (A) DEATH.
            (B) DISCHARGE OR RELEASE FROM ACTIVE DUTY OR THE SELRES, WITH AN HONORABLE CHARACTERIZATION OF SERVICE, DUE TO A MEDICAL CONDITION THAT PRE-EXISTED THE MEMBER'S SERVICE AND WAS NOT SERVICE-CONNECTED.
            (C) DISCHARGE OR RELEASE FROM ACTIVE DUTY OR THE SELRES, WITH AN HONORABLE CHARACTERIZATION OF SERVICE, FOR HARDSHIP AS DETERMINED BY THE COMMANDANT OF THE MARINE CORPS.
            (D) DISCHARGE OR RELEASE FROM ACTIVE DUTY OR THE SELRES, WITH AN HONORABLE CHARACTERIZATION OF SERVICE, DUE TO A PHYSCIAL OR MENTAL CONDITION, NOT CONSTITUTING A DISABILITY THAT DID NOT RESULT FROM THE MEMBER'S WILLFUL MISCONDUCT, BUT DID INTERFERE WITH THE PERFORMANCE OF DUTY.
            (E) DISCHARGE OR RELEASE FROM ACTIVE DUTY OR THE SELRES, WITH AN HONORABLE CHARACTERIZATION OF SERVICE, DUE TO A DISABILITY.
            (F) DISCHARGE OR RELEASE FROM ACTIVE DUTY OR THE SELRES, WITH AN HONORABLE CHARACTERIZATION OF SERVICE, DUE TO A REDUCTION IN FORCE OR FORCE SHAPING INITIATIVE.
    E.  POLICY FOR MARINES IN A LIMITED DUTY (LIMDU) STATUS. THIS POLICY ONLY APPLIES TO MARINES WHO HAVE COMPLETED TEN (10) OR MORE YEARS OF SERVICE IN THE ARMED FORCES THAT ARE IN A LIMITED DUTY STATUS AND REQUIRE ADDITIONAL OBLIGATED SERVICE FOR APPROVAL TO TRANSFER EDUCATION BENEFITS.
        (1) MARINE MUST WAIT UNTIL A FINAL DETERMINATION OF MEDICAL STATUS HAS BEEN COMPLETED.
        (2) MARINES WHO ARE FOUND FIT FOR CONTINUED NAVAL SERVICE WILL COMPLY WITH THE STANDARD TEB PROCEDURES PROVIDED IN PARAGRAPH 6 OF THIS MARADMIN.
        (3) MARINES WHO ARE FOUND UNFIT FOR CONTINUED NAVAL SERVICE AND DESIGNATED FOR A MEDICAL DISCHARGE/RETIREMENT MAY ELECT TO TRANSFER THEIR UNUSED POST 9-11 GI BILL EDUCATIONAL BENEFITS WITH NO ADDITIONAL SERVICE OBLIGATION.  HOWEVER, THE ELECTION MUST BE MADE PRIOR TO SEPARATION AND THE MARINE MUST BE AWARDED AN HONORABLE DISCHARGE.
    F.  RETROACTIVE APPROVAL OF PREVIOUSLY REJECTED TEB REQUESTS:
        (1) TEB REQUESTS MAY BE RETROACTIVELY APPROVED UNDER THE FOLLOWING CIRCUMSTANCES:
            (A) THE MEMBER REQUESTED TO TRANSFER THEIR UNUSED POST 9-11 GI BILL EDUCATIONAL BENEFITS VIA THE DMDC TEB WEB APPLICATION PRIOR TO SEPARATING FROM THE ARMED FORCES; AND
            (B) THE REQUEST WAS REJECTED (I.E., DISAPPROVED); AND
            (C) THE MEMBER, AT THE TIME OF THE TEB REQUEST, HAD TEN (10) OR MORE YEARS OF SERVICE IN THE ARMED FORCES; AND
            (D) THE MEMBER WAS MEDICALLY SEPARATED OR RETIRED, UNDER HONORABLE CONDITIONS, ON OR AFTER 1 AUGUST 2009.
        (2) FORMER MEMBERS THAT MAY BE ELIGIBLE FOR RETROACTIVE APPROVAL SHOULD CONTACT THE APPROPRIATE POINT OF CONTACT LISTED IN PARAGRAPH 5 OF THIS MARADMIN TO CONFIRM ELIGIBILITY AND EFFECT RETROACTIVE APPROVAL.

    H.  THE PROCEDURES OUTLINED ABOVE ARE FOR SERVICE APPROVAL OF TEB REQUESTS ONLY.  UPON APPROVAL OF TEB REQUESTS, MARINES OR THEIR DEPENDENTS ARE RESPONSIBLE FOR APPLYING TO THE DVA FOR ENROLLMENT AND APPROVAL TO USE POST 9-11 GI BILL BENEFITS, IN ACCORDANCE WITH PARAGRAPH 4.
8.  POLICIES AND PROCEDURES UNDER THIS PROGRAM ARE EFFECTIVE UPON RELEASE OF THIS MARADMIN.
