GENTEXT/REMARKS/1. PURPOSE. TO PROVIDE POLICY GUIDANCE WITH REGARD TO THE ASSIGNMENT OF, AND OPPORTUNITIES AVAILABLE TO, RESERVE COMPONENT (RC) MARINES WHO ARE HUMAN IMMUNODEFICIENCY VIRUS (HIV) POSITIVE.
2. REFERENCES (A) AND (B) PERMIT MEMBERS OF THE READY RESERVE WHO ARE HIV POSITIVE TO CONTINUE TO SERVE WITHIN THE MARINE CORPS RESERVE, BARRING ANY MEDICALLY ASSESSED UNFITTING CONDITIONS OF IMMUNOLOGIC DEFICIENCY, NEUROLOGIC DEFICIENCY, PROGRESSIVE CLINICAL OR LABORATORY ABNORMALITIES ASSOCIATED WITH HIV, OR DIAGNOSIS OF ACQUIRED IMMUNE DEFICIENCY SYNDROME (AIDS) DEFINING CONDITIONS.
3. REFERENCE (C) REITERATES THE LANGUAGE CONTAINED IN REFERENCES (A) AND (B) EXPLICITLY FOCUSED ON RC MARINES WITH HIV. HOWEVER, THE GUIDANCE CONTAINED IN REFERENCE (C) LACKS SUFFICIENT CLARIFICATION NECESSARY FOR THE SUPPORT, MANAGEMENT, AND ASSIGNMENT OF THIS POPULATION. THEREFORE, IN ORDER TO ENSURE APPROPRIATE MANAGEMENT OF THIS POPULATION, AND THE PROMULGATION OF ASSIGNMENT OPPORTUNITIES AVAILABLE, THE FOLLOWING AMPLIFYING POLICY GUIDANCE IS PROVIDED:
A. GUIDANCE SPECIFIC TO ACTIVE RESERVE (AR) MARINES WHO TEST HIV POSITIVE:
(1) AR MARINES WHO TEST HIV POSITIVE WILL BE ASSIGNED AND SUPPORTED IN A MANNER SIMILAR TO ACTIVE COMPONENT (AC) MARINES, AS STIPULATED BY THE REFERENCES.
(2) AR MARINES WHO ARE IDENTIFIED AS HIV POSITIVE WILL BE DIRECTED BY THE CHIEF, BUREAU OF MEDICINE AND SURGERY (BUMED) TO AN APPROPRIATE MEDICAL FACILITY FOR EVALUATION AND DETERMINATION OF FITNESS FOR DUTY.
(3) PER REFERENCE (D), MEDICALLY FIT AC MARINES WHO TEST HIV POSITIVE, WILL BE ASSIGNED, OR REASSIGNED, TO UNITS WHICH ARE NON- DEPLOYING, NON-OPERATING FORCE (NON-OPFOR), AND CONTINENTAL UNITED STATES (CONUS) BASED. SIMILARLY, ANY AR MARINE WHO TESTS POSITIVE FOR HIV WILL BE TRANSFERRED OUT OF ANY OPFOR, DEPLOYING, OR OUTSIDE CONUS (OCONUS) BASED UNITS.
(4) PER REFERENCES (E) AND (F), SELECTED MARINE CORPS RESERVE (SMCR) UNIT STRUCTURE IS INCLUDED IN THE MARINE CORPS OPFOR, AND AS SUCH ASSIGNMENT OF HIV-POSITIVE AR MEMBERS SHALL EXCLUDE BILLETS WHICH ARE INTEGRATED INTO THE SMCR UNIT STRUCTURE.
(5) TRANSFERS AND FOLLOW-ON ASSIGNMENTS OF HIV POSITIVE AR MARINES WHO ARE DETERMINED FIT FOR CONTINUED SERVICE WILL BE MANAGED BY THE DEPUTY COMMANDANT, MANPOWER AND RESERVE AFFAIRS (DC MRA)(RAM), WHO WILL MAINTAIN OVERSIGHT OF THIS POPULATION AND ENSURE THAT APPROPRIATE ASSIGNMENTS OCCUR.
(6) MEDICAL SCREENING, DOCUMENTATION, AND CERTIFICATIONS REQUIRED FOR THE CONTINUED SERVICE OF HIV POSITIVE AR MARINES ARE OUTLINED IN REFERENCES (B) THROUGH (D).
(7) HIV POSITIVE AR MARINES FOUND UNFIT FOR CONTINUED SERVICE WILL BE PROCESSED FOR MEDICAL SEPARATION VIA THE PHYSICAL INTEGRATED DISABILITY EVALUATION SYSTEM (IDES).
B. GUIDANCE SPECIFIC TO HIV POSITIVE RC MARINES (NON-AR):
(1) NON-AR RC MARINES WHO ARE IDENTIFIED AS HIV POSITIVE WILL BE COUNSELED BY A MEDICAL OFFICER, AND WILL BE SUBSEQUENTLY REFERRED TO THEIR PRIVATE PHYSICIAN FOR MEDICAL CARE AND EVALUATION OF FITNESS FOR CONTINUED SERVICE.
(2) IN ACCORDANCE WITH REFERENCES (A) THROUGH (C), HIV POSITIVE RC MARINES WHO ARE UNABLE TO BE UTILIZED WITHIN THE SELECTED RESERVE (SELRES) WILL BE TRANSFERRED INVOLUNTARILY TO THE STANDBY RESERVE INACTIVE STATUS LIST (ISL).
(A) THE REQUIREMENT FOR HIV POSITIVE RC MARINES TO EITHER BE UTILIZED IN THE SELRES, OR BE ASSIGNED TO THE ISL SPECIFICALLY EXCLUDES ASSIGNMENT TO THE INDIVIDUAL READY RESERVE (IRR) GIVEN THE FACT THAT THE IRR IS NOT PART OF THE SELRES. AS SUCH, HIV POSITIVE RC MARINES WHO ARE UNABLE TO OBTAIN A BILLET WITHIN THE SELRES WILL BE TRANSFERRED TO THE ISL AND WILL NOT BE PERMITTED TO BE PLACED WITHIN THE IRR.
(B) PER REFERENCE (D), MEDICALLY FIT AC MARINES WHO TEST HIV POSITIVE, WILL BE ASSIGNED, OR REASSIGNED, TO UNITS WHICH ARE NON-DEPLOYING, NON-OPFOR, AND CONUS BASED. SIMILARLY, ANY RC MARINE WHO TESTS POSITIVE FOR HIV WILL BE TRANSFERRED OUT OF ANY OPFOR UNITS. PER REFERENCES (E) AND (F), SMCR UNIT STRUCTURE IS INCLUDED IN THE MARINE CORPS OPFOR, AND AS SUCH ASSIGNMENT OF HIV-POSITIVE RC MEMBERS SHALL BE LIMITED TO NON-SMCR UNIT STRUCTURE.
(C) OPPORTUNITIES FOR CONTINUED PARTICIPATION IN THE SELRES REMAIN AVAILABLE TO MEDICALLY FIT HIV POSITIVE RC MARINES VIA ASSIGNMENT TO SPECIFIC NON-OPFOR, NON-DEPLOYING, CONUS BASED INDIVIDUAL MOBILIZATION AUGMENTEE (IMA) BILLET IDENTIFICATION CODES (BIC'S) WHICH ARE NOT PART OF SMCR UNIT STRUCTURE.
(3) HIV POSITIVE RC MARINES WHO ARE UNABLE OR UNWILLING TO TRANSITION TO AN APPROVED IMA BIC WILL BE INVOLUNTARILY TRANSFERRED TO THE ISL.
(4) HIV POSITIVE RC MARINES WHO ARE ASSIGNED TO DESIGNATED IMA BIC'S MUST COMPLETE ANNUAL MEDICAL RETENTION REVIEWS (MRR) AND PHYSICAL RISK CLASSIFICATION (PRC) ASSESSMENTS IN ORDER TO VERIFY THEIR CONTINUED FITNESS FOR DUTY. ADDITIONAL INFORMATION REGARDING REQUIRED MEDICAL TESTING AND ASSESSMENTS IS PROVIDED IN REFERENCE (B).
(A) FAILURE OF AN HIV POSITIVE RC MARINE ASSIGNED TO AN APPROVED IMA BIC TO COMPLETE THE REQUIRED EVALUATIONS WITHIN THE PRESCRIBED TIMELINES MAY RESULT IN THE INVOLUNTARY TRANSFER OF THE MARINE TO THE ISL AND OTHER APPROPRIATE ACTION AS REQUIRED.
(B) HIV POSITIVE RC MARINES ASSIGNED TO THE ISL MUST ALSO COMPLETE ANNUAL MRR'S AND PHYSICAL RISK CLASSIFICATION (PRC) ASSESSMENTS IN ORDER TO VERIFY THEIR CONTINUED FITNESS FOR DUTY AND CORRESPONDING UTILIZATION POTENTIAL. FAILURE OF MEMBERS OF THE ISL TO COMPLETE AND SUBMIT THE REQUIRED ANNUAL EVALUATIONS TO THE COMMANDER MARINE FORCES RESERVE (COMMARFORRES)(MCIRSA) MAY RESULT IN THE INITIATION OF ADMINISTRATIVE SEPARATION PROCESSING.
(5) PER REFERENCE (B), RC MEMBERS WHO ARE HIV POSITIVE ARE NOT ELIGIBLE FOR EXTENDED ACTIVE DUTY (ACTIVE DUTY FOR A PERIOD OF MORE THAN 30 DAYS) EXCEPT UNDER THE CONDITION OF MOBILIZATION AND ON THE DECISION OF THE SECRETARY OF THE NAVY (SECNAV). ACCORDINGLY, THE SECNAV MUST APPROVE ALL MOBILIZATIONS FOR RESERVE MEMBERS THAT ARE HIV POSITIVE AND FOUND FIT FOR CONTINUED SERVICE IN THE READY RESERVE IN A NON-DEPLOYABLE BILLET. MARINES OF THIS CATEGORY WHO VOLUNTEER FOR MOBILIZATION MUST SUBMIT A REQUEST TO THE DC MRA (MMIB) FOR PROCESSING AND FOLLOW-ON SUBMISSION TO THE SECNAV FOR DECISION.
(6) NON-AR MARINES ON ORDERS IN EXCESS OF 30 DAYS WHO ARE SUBSEQUENTLY IDENTIFIED AS BEING HIV POSITIVE WILL BE ADDRESSED ON A CASE BY CASE BASIS.
4. TASKS
A. MRA (RAM)
(1) SERVE AS THE RC HIV PROGRAM COORDINATOR.
(2) SCREEN AR PERSONNEL TO ENSURE COMPLIANCE WITH THE DIRECTION CONTAINED IN THE REFERENCES AND WITHIN THIS MESSAGE.
(3) ENSURE RC MARINES SELECTED FOR FULL-LENGTH SCHOOLS ARE APPROPRIATELY SCREENED FOR ELIGIBILITY IN ACCORDANCE WITH THE REFERENCES.
(4) WITH THE SUPPORT OF MRA (RIM) DESIGNATE THE IMA BIC'S WHICH MEET THE CRITERIA OF BEING POTENTIALLY AVAILABLE TO BE FILLED BY HIV POSITIVE RC MARINES (CONUS, NON-OPFOR, AND NON-DEPLOYABLE).
(5) CONTACT SMCR, IMA, AND IRR MARINES IDENTIFIED AS BEING HIV POSITIVE AND PROVIDE ASSISTANCE BY INFORMING THEM OF ALTERNATIVE SELRES PARTICIPATION OPPORTUNITIES. ENSURE THAT HIV POSITIVE RC MARINES ARE ONLY JOINED TO APPROPRIATE IMA BIC'S.
(6) PROVIDE TECHNICAL DIRECTION TO COMMARFORRES IN THE EXECUTION OF ASSIGNED RESPONSIBILITIES IN CONJUNCTION WITH THE MANAGEMENT OF HIV POSITIVE RC MARINES.
(7) CONTACT ALL RC MEMBERS (NON-AR) WHO ARE CURRENTLY KNOWN TO BE HIV POSITIVE WITHIN 90 DAYS OF THIS MESSAGE IN ORDER TO ENSURE APPROPRIATE BILLET ASSIGNMENT, DISCUSS POTENTIAL IMA BILLET OPPORTUNITIES, PROVIDE ASSISTANCE WITH ANY REQUEST FOR SEPARATION, OR TO GAIN ACKNOWLEDGEMENT OF THE MARINE'S TRANSFER TO THE ISL.
(8) CONTACT ALL RC MEMBERS (NON-AR) IDENTIFIED IN THE FUTURE AS HIV POSITIVE WITHIN 60 DAYS OF NOTIFICATION IN ORDER TO ENSURE APPROPRIATE BILLET ASSIGNMENT, DISCUSS POTENTIAL IMA BILLET OPPORTUNITIES, PROVIDE ASSISTANCE WITH ANY REQUEST FOR SEPARATION, AND TO COUNSEL THE MARINE ON THE REQUIREMENTS OF THIS MARADMIN AND ACKNOWLEDGE INVOLUNTARY TRANSFER TO THE ISL IF THE MARINE IS UNABLE OR UNWILLING TO EXECUTE AN INTER-UNIT TRANSFER TO AN IDENTIFIED AND AVAILABLE IMA BIC.
B. MRA (RAP-1). MAINTAIN OVERSIGHT OF THE POLICIES ASSOCIATED WITH THE ASSIGNMENT AND MANAGEMENT OF ALL HIV POSITIVE RC MARINES. AS REQUIRED, DEVELOP AND PUBLISH ADDITIONAL GUIDANCE FOR MANAGEMENT OF HIV POSITIVE RC MARINES.
C. MRA (RAP-3). SCREEN THE MARINE RESERVE ORDERS WRITING SYSTEM MROWS)REQUESTS FOR ORDERS TO ACTIVE DUTY (AD) OF HIV POSITIVE RC IMA MARINES IN ORDER TO ENSURE COMPLIANCE WITH THE REFERENCES AND THE GUIDANCE CONTAINED HEREIN:
(1) ENSURE NO AD IS PERFORMED OCONUS BY HIV POSITIVE RC MARINES
(2) ENSURE NO AD IN EXCESS OF 29 DAYS IS PERFORMED BY HIV POSITIVE RC MARINES (NON-AR) WITHOUT SECNAV APPROVAL
D. MRA (RIM). AS THE IMA PROGRAM MANAGER, PROVIDE SUPPORT TO MRA (RAM) IN THE DESIGNATION OF IMA BIC'S WHICH MEET THE CRITERIA OF BEING POTENTIALLY AVAILABLE TO BE FILLED BY HIV POSITIVE RC MARINES(CONUS, NON-OPFOR, AND NON-DEPLOYABLE).
E. MRA (MMIB). EVIEW AND PROCESS ANY REQUESTS FOR EXTENDED AD IN CONJUNCTION WITH MOBILIZATIONS BY ALL HIV POSITIVE NON-AR RC MARINES. FORWARD MRA RECOMMENDATIONS TO THE SECNAV FOR DECISION.
F. MARINE CORPS RECRUITING COMMAND (PRIOR SERVICE RECRUITING (PSR)). ENSURE THAT HIV POSITIVE RC MARINES (NON-AR) ARE ONLY JOINED TO BIC'S WHICH HAVE BEEN APPROVED BY RA (RAM) AS BEING APPROPRIATE FOR HIV POSITIVE MARINES. CONTACT RAM POC FOR GUIDANCE AS REQUIRED.
G. COMMARFORRES
(1) IN ACCORDANCE WITH THE REFERENCES, ENSURE THE CONDUCT OF REQUIRED HIV SCREENING:
(A) ENSURE ALL ASSIGNED RC MEMBERS REQUESTING AD OR ACTIVE DUTY FOR TRAINING (ADT) ORDERS IN EXCESS OF 30 DAYS HAVE A CURRENT NEGATIVE HIV TEST WITHIN THE PRECEDING 24 MONTHS.IF CURRENT HIV RESULTS CANNOT BE OBTAINED PRIOR TO THE REQUIRED AD, COMMARFORRES MAY PERMIT THE RC MARINE TO COMMENCE ORDERS; HOWEVER, THE REQUIRED TESTING MUST BE CONDUCTED WITHIN THE FIRST 10 DAYS OF AD. IN THIS CASE, MARINE'S ORDERS WILL BE TERMINATED IF FOUND TO BE HIV POSITIVE.
(B) ENSURE THAT ALL ASSIGNED RC SMCR PERSONNEL IDENTIFIED TO PERFORM DUTY OCONUS FOR ANY DURATION HAVE A NEGATIVE HIV TEST DOCUMENTED WITHIN 12 MONTHS OF THEIR DEPARTURE DATE.
(C) SCREEN ALL OTHER ASSIGNED SMCR UNIT MARINES NOT LESS THAN ONCE EVERY 24 MONTHS. OF NOTE, AS PER REFERENCE (B), RESERVE UNITS ARE NOT AUTHORIZED TO UTILIZE HIV TEST RESULTS OBTAINED FROM CIVILIAN BLOOD COLLECTION AGENCIES (E.G. AMERICAN RED CROSS).
(2) ENSURE THAT REQUIRED TRAINING, NOTIFICATIONS, AND REPORTING PROCEDURES OCCUR FOR SELRES MARINES SERVING WITHIN MARFORRES.
H. DIRECTOR, MARINE CORPS INDIVIDUAL RESERVE SUPPORT ACTIVITY(MCIRSA)
(1) ENSURE THAT HIV POSITIVE MARINES IN THE IMA AND ISL CONTINUE TO SUBMIT REQUIRED ANNUAL MEDICAL DOCUMENTATION DEPICTING FITNESS FOR DUTY.
(2) NOTIFY HIV POSITIVE MEMBERS OF THE ISL WHO FAIL TO PROVIDE THE REQUIRED ANNUAL MEDICAL DOCUMENTATION THAT THEY ARE SUBJECT TO ADMINISTRATIVE SEPARATION PROCESSING IN KEEPING WITH THE GUIDANCE CONTAINED IN REFERENCES (A) AND (B).
I. HIV POSITIVE RC MARINES
(1) ENSURE THE TIMELY COMPLETION OF ALL REQUIRED MEDICAL DOCUMENTATION, ASSESSMENTS, AND CERTIFICATIONS AS PER THE REFERENCES.
(2) ENSURE ALL PERSONAL CONTACT INFORMATION CONTAINED IN THE MARINE CORPS TOTAL FORCE SYSTEM (MCTFS) IS ACCURATE AND UP-TO-DATE IN ORDER TO ENABLE RA AND/OR MCIRSA TO DISCUSS POTENTIAL IMA BILLET OPPORTUNITIES, REQUESTS FOR SEPARATION, OR TO ACKNOWLEDGE TRANSFER TO THE ISL.
5. COORDINATING INSTRUCTIONS
A. PROCESS FOR MARINES DESIRING SEPARATION. AS EXPANDED UPON IN REFERENCE (B), HIV POSITIVE RC MARINES MAY APPLY FOR SEPARATION BY REASON OF HIV ANTIBODY POSITIVE STATUS WITHIN 90 DAYS OF THEIR INITIAL FORMAL COUNSELING.
B. PROCESS FOR HIV POSITIVE AR MARINES. THIS DIRECTIVE CONTAINS NO SUBSTANTIVE CHANGE TO THE POLICY CURRENTLY IN PLACE REGARDING THE MANAGEMENT AND ASSIGNMENT OF HIV POSITIVE AR MARINES.
C. PROCESS FOR RC NON-AR MARINES WHO HAVE BEEN IDENTIFIED AS BEING HIV POSITIVE PRIOR TO THE DATE OF RELEASE OF THIS MESSAGE.
(1) THE GUIDANCE AND REQUIREMENTS EXPANDED UPON IN THE RESPECTIVE REFERENCES WITH REGARD TO THIS POPULATION REMAIN GERMANE.
(2) ALL HIV POSITIVE RC (NON-AR) MARINES, TO INCLUDE THOSE MARINES IN THE IRR, SHALL BE CONTACTED BY THE MRA (RAM) POC WITHIN 90 DAYS AFTER THE PUBLISHING OF THIS MARADMIN IN ORDER TO ENSURE THE MARINE IS COUNSELED ON THE REQUIREMENT TO BE PLACED IN AN APPROPRIATE IMA BIC OR TO INITIATE TRANSFER OF THE MARINE TO THE ISL. AILURE TO TRANSFER INTO AN IDENTIFIED AND AVAILABLE BIC WITHIN 90 DAYS FROM MRA (RAM) CONTACT WILL RESULT IN THE INVOLUNTARY TRANSFER OF THE MARINE TO THE ISL.
D. PROCESS FOR RC (NON-AR) MARINES IDENTIFIED AS HIV POSITIVE FOLLOWING THE RELEASE OF THIS MESSAGE
(1) THE GUIDANCE AND REQUIREMENTS PROVIDED IN THE REFERENCES WITH REGARD TO THIS POPULATION REMAIN GERMANE.
(2) AS PER REFERENCE (B), RC MEMBERS IDENTIFIED AS BEING HIV POSITIVE SHALL BE COUNSELED BY A MEDICAL OFFICER, AND WILL SUBSEQUENTLY BE REFERRED TO THEIR PRIVATE PHYSICIAN FOR MEDICAL CARE AND COUNSELING WHICH MUST BE APPROPRIATELY DOCUMENTED IN THE MARINE'S RESPECTIVE MEDICAL RECORDS.
(3) MRA (RAM) POC WILL CONTACT THE HIV POSITIVE MEMBER UPON SERVICE NOTIFICATION. AT THAT TIME OPTIONS AVAILABLE TO THE HIV POSITIVE MEMBER WILL BE DISCUSSED AND AN INITIAL PLAN OF ACTION WILL BE DEVELOPED.
(3) HIV POSITIVE RC MARINES DESIRING TO BE RETAINED IN THE SELRES MUST OBTAIN AN EVALUATION FROM THEIR CIVILIAN PHYSICIAN CONFORMING TO THE PROTOCOL PRESCRIBED BY THE DOD FOR HIV EVALUATION AND WHICH COMPLIES WITH MEDICAL RETENTION REVIEW (MRR) AND PHYSICAL RISK CLASSIFICATION (PRC) REQUIREMENTS.
