GENTEXT/REMARKS/1. PURPOSE. LEAVE ACCRUAL AND CARRYOVER IS A PRIVILEGE FOR THE TOTAL FORCE. THIS MARADMIN ESTABLISHES POLICY FOR RESERVE COMPONENT (RC) MARINES LEAVE ACCRUAL IN ACCORDANCE WITH CHANGES TO REFERENCES A AND B. RC MARINES ARE AUTHORIZED TO CARRYOVER LEAVE EARNED DURING A PERIOD OF ACTIVE DUTY TO A SUBSEQUENT PERIOD OF ACTIVE DUTY SUBJECT TO THE LIMITATIONS IN REFS A AND B. PER REF B, ACTIVE SERVICE IS DEFINED AS SERVICE ON ACTIVE DUTY AND INCLUDES FULL-TIME TRAINING OR OTHER FULL-TIME DUTY. THIS CHANGE FURTHER ALIGNS AC/RC LEAVE POLICY.
2. POLICY. PER REF C, UPON HONORABLE RELEASE FROM A PERIOD OF ACTIVE DUTY IN SUPPORT OF A CONTINGENCY FOR ANY PERIOD OF TIME, OR FROM A PERIOD OF NON-CONTINGENCY ACTIVE DUTY OF 31-365 DAYS, A RESERVE MARINE MAY ELECT TO SELL EARNED LEAVE BACK AS LUMP SUM LEAVE (LSL) OR CARRYOVER UNUSED LEAVE INTO A FUTURE PERIOD OF ACTIVE SERVICE WHEN THE MARINE WOULD BE ENTITLED TO LEAVE.
3. LIMITATIONS. IF LEAVE IS EARNED DURING A PERIOD OF LESS THAN 31 DAYS, LSL WILL COUNT AGAINST THE 60 DAY SERVICE LIMIT PER REF B. IFRC MARINES ACCRUE LEAVE DURING A PERIOD OF ACTIVE SERVICE OF MORE THAN 30 BUT LESS THAN OR EQUAL TO 365 DAYS THEY ARE EXEMPT FROM THE MAXIMUM 60 DAYS LSL IN A CAREER IAW REF D. RC MARINES SERVING ON ACTIVE DUTY FOR PERIODS GREATER THAN 365 DAYS WILL BE SUBJECT TO THE SAME LSL ACCUMULATION LIMITATIONS AS ACTIVE COMPONENT (AC) MARINES IAW REF A.
4. EXAMPLES.
  A. RC MARINE ON ACTIVE DUTY (ACDU) ORDERS 20150601-20150630 (30 DAYS) MAY USE OR SELL BACK LSL. SALE OF THE LEAVE DAYS EARNED DURING THIS PERIOD WILL COUNT AGAINST THE 60-DAY SERVICE LIMIT.
  B. RC MARINE ON BACK TO BACK SHORT TOUR ACDU ORDERS 20150615-20150630 AND 20150701-20150715 (31 DAYS) MAY USE, SELL BACK OR CARRYOVER EARNED LEAVE. SALE OF THE LEAVE DAYS EARNED DURING THIS PERIOD WILL NOT COUNT AGAINST THE 60-DAY SERVICE LIMIT.
  C. RC MARINE ON ACDU ORDERS 20141001-20150930 (365 DAYS) MAY USE, SELL BACK OR CARRYOVER EARNED LEAVE. SALE OF THE LEAVE DAYS EARNED DURING THIS PERIOD WILL NOT COUNT AGAINST THE 60-DAY SERVICE LIMIT.
  D. RC MARINE ON BACK TO BACK ACDU ORDERS 20151001-20160331 AND 20160401-20160930 (366 DAYS DUE TO LEAP YEAR) MAY USE, SELL BACK OR CARRY OVER EARNED LEAVE DURING THIS PERIOD. SALE OF THE LEAVE DAYS EARNED DURING THIS PERIOD WILL COUNT AGAINST THE 60-DAY SERVICE LIMIT.
5. PROCESS. RC MARINES WHO ARE ELECTING TO CARRY THEIR UNUSED LEAVE BALANCE FORWARD MUST SIGN A STATEMENT UPON SEPARATION FROM A PERIOD OF ACTIVE DUTY IAW REF E AND F. ANY RESERVE MARINE HONORABLY SEPARATING FROM A PERIOD OF ACTIVE DUTY WHO DOES NOT SPECIFICALLY ELECT IN WRITING TO CARRY THEIR REMAINING LEAVE BALANCE OVER TO A SUBSEQUENT PERIOD OF ACTIVE DUTY WILL AUTOMATICALLY HAVE THEIR LEAVE BALANCE SOLD AS LSL.
6. BACK TO BACK ORDERS. WHEN TWO SETS OF ORDERS ARE ISSUED WITHOUT A BREAK IN CONTINUOUS ACTIVE SERVICE, THE ENTIRE PERIOD IS CONSIDERED IN COMPUTING THE ENTITLEMENT TO SELL MORE THAN 60 DAYS OF LEAVE. THE ENTITLEMENT TO SELL OVER 60 DAYS OF LEAVE IS BASED ON CONTINUOUS ACTIVE DUTY SERVICE AND NOT ON THE DAYS THE MEMBER WAS ORDERED TO ACTIVE DUTY ON AN INDIVIDUAL SET OF ORDERS. THE MEMBER’S LEAVE WILL BE AUTOMATICALLY CARRIED FORWARD TO EACH CONSECUTIVE ACTIVE DUTY PERIOD UNTIL THE MEMBER IS SEPARATED FROM CONTINUOUS ACTIVE DUTY. REF C AMPLIFIES COMPUTATION OF LEAVE ACCRUAL.
7. IF AN RC MARINE ELECTS TO CARRY A REMAINING LEAVE BALANCE OVER TO A SUBSEQUENT PERIOD OF ACTIVE DUTY AND IS INDEBTED TO THE GOVERNMENT, THE FINANCE OFFICE WILL SELL THE APPROPRIATE NUMBER OF WHOLE DAYS LEAVE TO COVER THE DEBT. LEAVE REMAINING AFTER THE DEBT TO THE GOVERNMENT HAS BEEN SATISFIED WILL BE CARRIED OVER.
8. DEATH OF ELIGIBLE RC MARINES. PAYMENTS FOR UNUSED ACCRUED LEAVE WILL BE MADE TO BENEFICIARIES IAW REF C.
9. END OF OBLIGATED SERVICE. UPON RELEASE FROM THE RC UNDER HONORABLE CONDITIONS ELIGIBLE RC MARINES MAY RECEIVE PAYMENT OF REMAINING UNUSED LEAVE IAW REF C AND D.
10. PER REFERENCE G, EXTENSION OF ORDERS TO EXECUTE ACCRUED LEAVE SHALL NOT BE APPROVED.
11. IN ACCORDANCE WITH REF H LEAVE GRANTING AUTHORITIES ACROSS THE TOTAL FORCE SHALL ENCOURAGE AND ASSIST ALL MARINES TO USE THEIR ENTIRE 30-DAYS OF LEAVE EACH YEAR. RC MARINES SHALL BE ENCOURAGED TO USE THEIR LEAVE IN THE ACTIVE DUTY PERIOD IN WHICH IT IS EARNED. USE OF THE LEAVE SYSTEM AS AN EXTRA MONEY PROGRAM, EITHER AS A METHOD OF COMPENSATION OR AS A CAREER CONTINUATION INCENTIVE, DEFEATS THE INTENT OF CONGRESS TO PROVIDE FOR THE HEALTH AND WELFARE OF SERVICE MEMBERS. IT IS SPECIFICALLY INTENDED THAT LARGE LEAVE BALANCES NOT BE ACCRUED EXPRESSLY FOR SETTLEMENT UPON SEPARATION OR RELEASE FROM ACTIVE DUTY.
12. RELEASE AUTHORIZED BY MR. M. F. APPLEGATE, DIRECTOR, MANPOWER PLANS AND POLICY DIVISION.//
