GENTEXT/REMARKS/1. PURPOSE. TO REISSUE ADR PROGRAM GUIDANCE TO CLARIFY MANAGEMENT AND OVERSIGHT ROLES AND RESPONSIBILITIES RESIDE WITH THE HUMAN RESOURCES DIRECTOR (HRD) AND HUMAN RESOURCES OFFICE (HRO) SATELLITE MANAGER. COMMAND ADR PROGRAMS MUST BE ESTABLISHED AND EXECUTED PER THE POLICY AND GUIDANCE CONTAINED IN THIS MARADMIN AND THE REFERENCES.
2. BACKGROUND. CIVILIAN EMPLOYEES HAVE SEVERAL FORMAL AND INFORMAL AVENUES FOR ADDRESSING COMPLAINTS, GRIEVANCES, OR OTHER TYPES OF WORKPLACE DISPUTES. ADR PROVIDES EMPLOYEES AND COMMANDS AN ALTERNATIVE TO LITIGATION OR FORMAL ADMINISTRATIVE PROCEDURES.  THE GOAL IS TO RESOLVE THESE DISPUTES AT THE LOWEST LEVEL AND AVOID ANY POTENTIAL DISTRESS AND DISRUPTION TO UNIT COHESIVENESS.  AN EMPLOYEE MAY SEEK THE APPROPRIATE RESOLUTION PROCESS THROUGH THEIR CHAIN OF COMMAND, AN EQUAL EMPLOYMENT OPPORTUNITY (EEO) COUNSELOR, AN EMPLOYEE RELATIONS SPECIALIST OR AN ADR CONVENER. IF THE EMPLOYEE ELECTS ADR AS THE METHOD OF RESOLVING THEIR CONCERN, A CONVENER WILL EXPLAIN THE ADR PROCESS TO THE EMPLOYEE AND PROCEED WITH ORGANIZING AN ADR EVENT.  THIS PROCEDURE APPLIES TO A VARIETY OF WORKPLACE DISPUTES TO INCLUDE, BUT NOT LIMITED TO:
   A. EEO CONCERNS;
   B. WORKPLACE CONFLICT;
   C. ADMINISTRATIVE GRIEVANCES;
   D. LABOR MANAGEMENT DISPUTES.
3. ROLES AND RESPONSIBILITIES: THE HRD/HRO SATELLITE MANAGERS HAVE OVERALL RESPONSIBILITY FOR ADR SERVICE DELIVERY FOR THE MARINE CORPS COMMANDS THEY SUPPORT AND WILL APPOINT IN WRITING, AN ADR PROGRAM COORDINATOR AND A CONVENER AT EACH HRD AND HRO SATELLITE OFFICE TO PROMOTE SPEEDY DISPUTE RESOLUTION AT THE LOWEST POSSIBLE LEVEL. THE ADR PROGRAM COORDINATOR WILL SOLICIT FOR MEDIATORS OR CONCILIATORS, COORDINATE AND MONITOR TRAINING AND CERTIFICATIONS, PROVIDE PROGRAM MANAGEMENT, CONDUCT MARKETING AND SUBMIT REPORTS. THE ADR CONVENER WILL DOCUMENT AND MANAGE THE MEETING PROCESS AND LOGISTICS FOR ADR MEDIATION OR CONCILIATION SESSIONS PER REFERENCE (C).
4. ADR FACILITATORS ARE NEUTRAL PARTIES ASSIGNED TO CONDUCT ADR MEDIATION OR CONCILIATION SESSIONS AT MARINE CORPS INSTALLATIONS.  MEDIATION SESSIONS ARE ASSIGNED BY THE DEPARTMENT OF NAVY (DON) CENTER OF EXCELLENCE (COE).  CONCILIATION SESSIONS ARE ASSIGNED BY THE HRD/HRO MARINE CORPS ADR COORDINATOR. ADRTRACKER PROGRAM SOFTWARE WILL BE USED BY ADR CONVENERS TO DOCUMENT MEDIATION OR CONCILIATION SESSIONS PER REF (C).
5. WHERE COMMANDS DO NOT HAVE LOCAL ACCESS TO THEIR HRD/HRO SATELLITE OFFICE, THE HRD/HRO SATELLITE MANAGER MAY APPOINT, IN WRITING, A LOCAL LIAISON TO INTERFACE WITH THE DESIGNATED ADR PROGRAM COORDINATOR AND CONVENER TO ARRANGE ADR SERVICES.
6. EACH ADR PROGRAM COORDINATOR IS REQUIRED TO SUBMIT AN ANNUAL CONFLICT MANAGEMENT AND MEDIATION MODEL (CM3) REPORT TO THE MARINE CORPS ADR PROGRAM MANAGER.  THE REPORT PROVIDES DATA REGARDING THE COMMAND’S MEDIATION AND CONCILIATION EFFORTS THROUGHOUT THE YEAR.  THE DATA CALL WILL BE DISTRIBUTED TO HRD/HRO SATELLITE MANAGERS BY THE MARINE CORPS ADR PROGRAM MANAGER DURING THE 4TH QUARTER OF EACH FISCAL YEAR.
