NARR/REFERENCE (A) IS MCO 5500.6H, MARINE CORPS ORDER ON ARMING OF LAW ENFORCEMENT AND SECURITY PERSONNEL AND THE USE OF FORCE. REFERENCE (B) IS MARADMIN 599-15, WHICH PROVIDED CLARIFICATION OF MARINE CORPS POLICY, AUTHORITIES, AND PROCEDURES RELATIVE TO AUGMENTING SECURITY AND ARMING PERSONNEL IN THE PERFORMANCE OF SECURITY DUTIES. GENTEXT/REMARKS/1. Active Duty, Reserve, and Civilian Marine Corps personnel, assigned to perform security duties, to include command duty officers and other armed duties, fall under the uniform procedures and criteria outlined in ref (a). Ref (b) emphasizes compliance with ref (a), and called for commanders’ particular attention to its provisions regarding authorized weapons, carrying configuration and ammunition, as well as required weapons qualifications. The purpose of this MARADMIN is to reemphasize the appropriate weapons condition for government weapons utilized for law enforcement and security purposes, inclusive of those personnel performing armed interior guard and “as needed” duty functions as defined in ref (a).
2. Per ref (a), weapons used for law enforcement and security purposes shall comply with the following criteria for Authorized Weapons, Carrying Configuration, and additional Ammunition requirements:
2.a. M9 service pistol shall be carried in CONDITION ONE with a fully loaded magazine inserted, round in chamber, slide forward, hammer down, and safety on, with a minimum of one additional fully loaded magazine.
2.b. Close Quarters Battle Pistol (.45 Caliber) shall be carried in CONDITION ONE with a fully loaded magazine inserted, round in chamber, slide forward, hammer cocked, and safety on, with a minimum of one additional fully loaded magazine.
2.c. M16A2/M16A4/M4 Rifle shall be carried in CONDITION THREE with a fully loaded magazine inserted, empty chamber, bolt forward, safety on, and ejection port cover closed, with a minimum of one additional fully loaded magazine.
2.d. Shotguns shall be carried in CONDITION THREE with a fully loaded magazine tube, empty chamber, bolt forward, safety on, and at least five additional rounds.
3. When armed with firearms that are not routinely carried in CONDITION ONE, as described above, rounds will not be chambered unless the immediate threat makes it reasonable and prudent to believe that the use of deadly force may be necessary.
4. Certain law enforcement and security personnel, such as those performing civil disturbance missions, crowd control and brig duties, are exempted from the requirement to be armed with loaded weapons. Instead, they may be armed with equipment consistent with the operating environment and which is necessary to accomplish the mission.
5. During training such as reaction drills, the manner in which firearms are carried will be governed by considerations for safety and the operating environment. Commanders will exercise common sense in arriving at a balance between training realism and safety.
6. Only Government-owned and issued weapons and ammunition are permitted to be carried by Marines and civilian personnel of the Marine Corps performing law enforcement and security duties.
7. Weapons Handling.
7.a. Per ref (a), periodic training in weapons safety to include handling, clearing, carriage, and storage of firearms is mandatory.
7.b. Training must focus on the individual’s overall responsibility for weapons safety in order to prevent injury or death caused by carelessness, neglect, or failure to properly secure weapons.
7.c. Training must include an evaluation of the individual’s understanding of weapons safety and handling.
8. Effective immediately, commanders will ensure adherence to this policy, for all Marine Corps personnel assigned to perform security duties (to include command duty officers, officers of the day, staff duty non-commissioned officers, squadron duty officers, and other personnel performing security duties on an “as needed basis” IAW ref (a)) that are armed with the service pistol.
9. This MARADMIN is applicable to the Total Force Marine Corps.
9.a. This policy does not apply to Marine Corps personnel performing military operations subject to the Department of Defense (DOD) Standing Rules of Engagement in CJCSI 3121.01B (S) or mission specific rules of engagement (ROE). Domestic military activities, including homeland defense missions and law enforcement and security duties will be conducted consistent with this MARADMIN and ref (a), unless other superseding laws, regulations, or mission specific rules for the use of force (RUF) specifically apply. This includes domestic operations where the Marine Corps is in support of other federal, state, or local agencies. This MARADMIN also applies to law enforcement and security duties conducted outside U.S. territory.
9.b. Personnel serving under the operational control of another federal agency and authorized or directed to carry firearms in support of the mission are subject to the approval and requirements of both that federal agency and the Marine Corps. Marine and civilian personnel of the Marine Corps will adhere to that agency’s firearms policies after being thoroughly trained in applying those policies. Conservation law enforcement officers shall comply with MCO 5090.4A for the use of force.
9.c. Marine Corps commands residing as tenants aboard another Service’s installation may arm security personnel in areas under the Marine Corps commander’s control, subject to coordination with the host installation commander. Commanders shall notify HQMC (PS), via AMHS, of any conflict in policy with the host installation regarding arming of law enforcement and security personnel in areas subject to the control of the Marine Corps commander.
9.d. Government weapons may be carried off base by law enforcement and security personnel only while engaged in official duties. The installation staff judge advocate, Provost Marshal, and installation commanding officer will be consulted before conducting law enforcement or security duties off a military installation, with the exception of routine duties associated with criminal investigations conducted by Criminal Investigative Division (CID) personnel. Per ref (b), arming of security personnel outside of normal operations requires OPREP-3 reporting to HQMC Operations Center.
