GENTEXT/REMARKS/1.  THIS MARADMIN APPLIES TO APPROPRIATED AND NON-APPROPRIATED FUND ORGANIZATIONS EMPLOYING BARGAINING UNIT EMPLOYEES.
2.  ON 9 DECEMBER 2009, POTUS SIGNED EO 13522, "CREATING LABOR-MANAGEMENT FORUMS (LMF) TO IMPROVE DELIVERY OF GOVERNMENT SERVICES" THUS AFFIRMING HIS COMMITMENT TO ESTABLISH LMF THAT FOSTER COOPERATION BETWEEN LABOR AND MANAGEMENT IN FEDERAL AGENCIES WITH A GOAL OF IMPROVING GOVERNMENT SERVICES.
3.  THE MARINE CORPS HAS BEEN DIRECTED BY THE DEPARTMENT OF THE NAVY (DON) TO BEGIN IMPLEMENTING LMF AT THE HEADQUARTERS AND LOCAL LEVELS IN COMPLIANCE WITH THE EO 13522.  THE LMF CAN SERVE AS A VEHICLE TO IMPROVE THE WORKING RELATIONSHIP BETWEEN MANAGERS AND EMPLOYEE REPRESENTATIVES AS WELL AS, ACHIEVING RESULTS AND MAKING A DIFFERENCE FOR ORGANIZATIONS, MANAGERS, AND EMPLOYEES.
4.  AGENCY HEADS/COMMANDERS SHALL ESTABLISH OR ADAPT EXISTING LMF TO HELP PROMOTE CHANGE WITHIN THE GOVERNMENT SERVICES.  THE GOALS OF THE EO ARE:
    A. PROACTIVELY INVOLVE UNIONS/EMPLOYEES AS FULL PARTNERS TO IDENTIFY PROBLEMS AND CRAFT SOLUTIONS TO BETTER SERVE CUSTOMERS AND THE MISSION;
    B. ALLOW UNIONS/EMPLOYEES TO HAVE PRE-DECISIONAL INVOLVEMENT IN ALL WORKPLACE MATTERS, TO THE FULLEST EXTENT PRACTICABLE, AND INFORMATION NOT PROHIBITED BY LAW TO INCLUDE THOSE MANAGEMENT RIGHTS CURRENTLY NON-NEGOTIABLE WHICH ARE LISTED BELOW; AND
    C. EVALUATE AND DOCUMENT PROGRESS AND IMPROVEMENT IN EMPLOYEE SATISFACTION AND ORGANIZATIONAL PERFORMANCE.
5.  THE CIVILIAN HUMAN RESOURCES OFFICES LABOR RELATIONS (LR) SPECIALISTS HAVE THE RESPONSIBILITY TO IMPLEMENT THE EO 13522 WITH THEIR LOCAL UNION PRESIDENT OR HIS/HER DESIGNEE.  THIS IS A COLLABORATIVE PROCESS IN ORDER TO ENGAGE THE UNIONS IN RE-DECISIONAL CONSULTATION PERTAINING TO PERSONNEL PRACTICES, POLICIES, AND CHANGES TO WORKING CONDITIONS AFFECTING THE BARGAINING UNIT EMPLOYEES.  THE ACTIVITY MUST MAKE A GOOD-FAITH ATTEMPT TO REACH AGREEMENT BETWEEN LABOR AND MANAGEMENT.  MANAGEMENT RIGHTS ARE:
    A. DETERMINE THE AGENCY'S MISSION, BUDGET, ORGANIZATION, NUMBER OF EMPLOYEES, AND INTERNAL SECURITY PRACTICES;
    B. HIRE, ASSIGN, DIRECT, LAY OFF, AND RETAIN EMPLOYEES;
    C. SUSPEND, REMOVE REDUCE IN GRADE OR PAY, OR DISCIPLINE EMPLOYEES;
    D. ASSIGN WORK, MAKE DETERMINATIONS WITH RESPECT TO CONTRACTING OUT, AND DETERMINE THE PERSONNEL BY WHICH OPERATIONS WILL BE CONDUCTED;
    E. SELECT AND APPOINT EMPLOYEES FROM APPROPRIATE SOURCES; AND
    F. TAKE WHATEVER ACTIONS MAY BE NECESSARY TO CARRY OUT THE AGENCY MISSION DURING EMERGENCIES.
6.  AGENCY HEADS/COMMANDERS SHALL RELEASE ONE LR SPECIALIST AND UNION REPRESENTATIVE FROM OFFICIAL DUTY TO ATTEND TRAINING PROVIDED BY THE FEDERAL LABOR RELATIONS AUTHORITY, OFFICE OF GENERAL COUNSEL AND THE FEDERAL MEDIATION AND CONCILIATION SERVICE.  HQMC MPC-40 WILL COORDINATE AND PUBLISH THE TRAINING AND PROVIDE INFORMATION TO THE LR SPECIALISTS AND UNION REPRESENTATIVES UNDER SEPARATE COVER.  TRAINING IS AN INTEGRAL PART OF THE CHANGE IN LABOR-MANAGEMENT DIRECTION AND IS DESIGNED TO ENHANCE THE PARTICIPANTS (HEADQUARTERS AND LOCAL LEVELS) KNOWLEDGE OF BARGAINING RIGHTS AND OBLIGATIONS UNDER THE FEDERAL SERVICE LABOR-MANAGEMENT RELATIONS STATUTE.  LR SPECIALISTS MUST ATTEND THE TRAINING WITH ONE BARGAINING COUNTERPART SO THAT MANAGEMENT AND THE UNION HAVE A COMMON UNDERSTANDING OF THE INFORMATION AND SKILLS NEEDED FOR EFFECTIVE LMF.
